Why didn't the judge in the E Jean Carroll trial not want these tweets by Carroll

Because they would have destroyed what the court was there to do. Hurt Trump.

No way Trump would ever bang that broad. She's ugly.
HoraceGreenley · 56-60, M
@ElwoodBlues You're right about the lawsuits. The simple fact is, i don't care.

She accuses Trump of rape while he's President. He denies her claim which she then uses to for defamation.

That makes her even more odious. Obviously, she's politically motivated. And your a moron to think Trump would rape this slimey woman in a department store in the middle of the day.
@HoraceGreenley
So what? She first sued for sexual assault.
That, as you've admitted, was an error.
I looked.
Whereas THAT was a LIE.
He denies her claim which she then uses to for defamation.
He did so much more than merely deny. He used the "bully pulpit" of the presidency (phrase goes back to Teddy R) to heap insults and falsehoods on Ms Carroll. Repeatedly. Yes, he went way way farther than denial; that was his defamation.

And the first jury decision, for $5 million in May 2023, was to tell him to shut up with his insults and falsehoods. But of course he didn't shut up, he piled on even more defamation; that $5 million was too small a penalty to shut up Trump. And that allowed E. Jean's lawyers to argue that some really big penalty was needed to shut him up. It was a winning argument.

Despicable lying sack of corruption Trump made his bed; now he has to lie in it.
HoraceGreenley · 56-60, M
@ElwoodBlues
She's still despicable
EnglishLitLover · 56-60, M
Looking at the situation from across the Atlantic, my understanding of the system is that they were totally irrelevant to the matter being considered ...

Trump had already been found guilty of sexual molestation at his earlier trial ...

This trial was not concerned with reviewing a case which had already been tried but was concerned about setting punitive amounts of money to compensate the damage caused...
Slade · 56-60, M
@MasterLee Yes. Burden of proof far lower in a civil court
MasterLee · 56-60, M
@Slade preponderance of evidence can indict a ham sandwich.
Slade · 56-60, M
@MasterLee just means you guess there could be a chance...
(1) They had not been entered as evidence for the trial - all evidence needs to be entered in a timely manner so both sides can see it, verify it for accuracy, etc.

(2) Trump had already been found, in a prior trial, to have committed sexual assault, penetrating her with his finger, which constitutes rape in many jurisdictions. That finding is now a matter of law, particularly for purposes of this trial.

[sep][sep][sep] UPDATE [sep][sep][sep]
I believe SOME of the tweets were entered as evidence and considered during the trial, but Habba tried to read from other tweets which had NOT been entered as evidence. Mixing all the tweets - evidentiary and non-evidentiary - together in one image is a misleading tactic.
@ElwoodBlues indeed, the case was already settled, this second lawsuit only exists becasue Trump is a little baby who can never shut up

I fully expect the cycle to repeat, with him running his mouth about her again, and there being a third lawsuit, and maybe by then he'll owe her $300 million

What's especially insane is that MAGA idiots will donate money to a rich man who could pay his own bills, and on top of this, Florida GQP legislators were somehow proposing that all Florida taxpayers should pay his bills too .... Republicans are batshit crazy
GuiltyBiStander · 31-35, F
Not sure I know what you mean - Because the judge did admit all those tweets as evidence, they were filed as exhibits on the record, and argued in open court by his defense attorneys :

As far as I can tell Trump's biggest problem isn't "the deep state" or a "rigged system", it's juries of ordinary people who hear all his excuses - and just don't buy it.
@GuiltyBiStander and that is a right wing source no less, surprising that they aren't lying for Trump

https://mediabiasfactcheck.com/the-messenger-bias-and-credibility/

Don't you love how MAGAts are always posting MEMES like they have some kind of brilliant gotcha checkmate bit of pseudo-discourse?
@GuiltyBiStander Interesting take on Trump's chances for an appeal:

@needsmilk808 says
the main stream media, Fauchy, CDC and others did a very convincing job of turning untold flue and various other misc. deaths into convincing proof of a pandemic here in the US
[big] Are the Covid death numbers the result of mis-classification of other causes of death? [/big]

Here in the table are US death numbers for the top ten causes of death for six years ending in 2020. Notice how there are 20% more deaths in 2020 than the average of the previous five years? Doing the math, that's 500,000 excess deaths in 2020.

Notice how, in 2020, 345,000 of those 500,000 excess deaths are classified as Covid? Notice how almost all causes of death rose in 2020, including cancer & heart disease?
https://jamanetwork.com/journals/jama/fullarticle/2778234

If there's any validity to the claim that lots of deaths have been mis-classified as Covid, why did almost all causes of death increase in 2020? Wouldn't mis-classification produce a reduction in those other causes? The evidence says mis-classification is a red herring.

Josh1454 · M
@ElwoodBlues you’ll never win. They don’t like facts. Also, if you ask where they got their info they’ll tell you just to check online.
@Josh1454 Their inability to respond is a win for me. And I have these fact filled items in an easy cut-n-paste file so its low effort.
Josh1454 · M
@ElwoodBlues yeah on top of that they try and dismiss when you have a family member die of Covid. They’ll say shit like they probably had some underlying issue you didn’t know about.
needsmilk808 · 56-60, M
It would have hurt the judges desired outcome.

@needsmilk808 why did you think it necessary to change the subject? Do you understand that the lawyers present their cars and a jury makes the decision, twice there we juries who found him guilty.
@soar2newhighs Do you have proof of that? You need to read the indictments. There’s a lot of evidence against your orange lord and savior.
Josh1454 · M
I’m wondering if people can’t figure out these are fake? To top it off, people actually want someone who was found guilty of rape in power. People will say it’s fake, however, we all heard his words before he was elected about how easy it was to grab a woman by the pussy.
It’s somewhat interesting that Trump has a female ( daughter of Iraqi immigrant parents who fled Iraq because of persecution) as his counsel. So xenophobic and misogynistic isn’t he?
Interesting how presidents and dresses have or suddenly don’t have bearing. Monica’s dress ; and Ms. Carroll’s dress she alleges she had on; not even designed as the dress makers attested!
Is there a NYPD police report, a medical report substantiating Ms. Carroll was sexually assaulted, no less in a major well known NYC store? No one around to hear her scream she was being assaulted?
Her interview recently might just show a good deal about her and her character. Even the interviewer had difficulty in dealing with her responses.
A NY jury? They’d indict a ham sandwich.
For Ms. Carroll’s sake if this falls apart, and it might she’s done…stick a fork in her!
@Lila15
Not sure but if this is accurate she and her attorney may face many obstacles.
MasterLee · 56-60, M
@soar2newhighs reade, ford, carroll...all political bimbos
Lila15 · 22-25, F
@soar2newhighs I had the impression that she was a bit unstable. The attention from her accusation led to an examination of expert testimony she had provided in several trials, where she lied about her credentials. So she may have fled the country to avoid potential prosecution. Also, all of that would have been brought up in court if she sued Biden for defamation.

Sexual assaulters and rapists tend to have multiple victims. No one else has accused Biden of sexual assault, other than people obsessing over him appearing to sniff childrens' hair while their parents watched in obvious delight. Trump, on the other hand, has been accused of sexual assault by over two dozen women. Carroll is the only one who sued and obtained a judgment. The woman who sued him for assault when she was 13 dropped her suit, probably due to intimidation. This isn't implausible as Carroll and her attorney have received death threats from Trump supporters.
For the same reasons as below...

She's bankrolled by billionaire leftist, and LinkedIn co-founder, Reid Hoffman.

They had to get the law changed in 2022 to extend the statute of limitations for sexual assault civil lawsuits beyond 20 years.

A liberal NY jury didn't agree with the rape charge.

Carroll's legal team presented zero evidence of sexual assault. Trump says he's never met her.

The left will do anything to stop Trump.

Trump is powerful enough to be with extremely attractive women. He is married to a drop dead gorgeous super model. Why would he sexually assault a dump truck?

Assuming they are real - I am sure they were provided in the trial that determined whether Donald was liable or not.

They would be irrelevant in determining the amount of the liability.

Dates are important. If these tweets happened long after the alleged rape they're irrelevant.
Sarasmiles · 41-45
According to Washington Examiner writer Byron York, Carroll’s suit against Trump began at the home of NeverTrump blogger Molly Jong Fast: The party was in honor of yet another Resistance figure, the comedian Kathy Griffin.

Among those in attendance was still another Resistance figure, the lawyer George Conway. The gathering was, in the words of a New York Times account, “Resistance Twitter come to life.” Conway was someone important for Carroll to meet. A high-powered lawyer, back in the 1990s, he had been part of the so-called elves, a group of lawyers who secretly helped Paula Jones sue President Bill Clinton for sexual harassment.

By 2019, Conway was in a far different position. His wife, Kellyanne Conway, ran Trump’s campaign and went to the White House as a top adviser. For his part, George Conway was originally interested in a big job in the Trump Justice Department. Later, when that did not happen, he became virulently anti-Trump, so much so that he would be invited to a party for Griffin at Jong-Fast’s apartment. At that party, Conway became an elf all over again. As the guests enjoyed themselves — the catering was by Momofuku and was said to be excellent — Conway persuaded Carroll that she should sue Trump for defamation.

The idea was that when Trump denied having met her and then said she was making up the rape accusation to sell a book and then said she, Carroll, was not his type, that was all defamation. Carroll could sue Trump for that, and then, of course, the case would focus on whether the alleged rape actually occurred, so it would be like having a rape trial for Trump even though the statute of limitations was long passed.
ServantOfTheGoddess · 61-69, M
1) a quick look on line tells me that at least some of these were shown at the trial. 2) If your point is that a woman who talks about sex and likes to seduce men cannot be raped, you're just wrong. If your point is that such a woman deserves to be raped, I have nothing to say to you ever.
Handfull1 · 61-69, F
@ServantOfTheGoddess best answer from me anyway!
Josh1454 · M
@ServantOfTheGoddess sadly for Trump supporters, someone that doesn’t support Trump is obviously not a person and therefore does not merit the same sympathy as a Trump supporter.
Handfull1 · 61-69, F
Either way, it’s like wearing revealing clothes. None of that gives men a right to sexually assault!
Handfull1 · 61-69, F
@nedkelly your wife is one woman. Everyone is different. You can surely have your opinion as I can have mine. I have the edge tho since I’m female. Like only you would know why guys think the size of their dicks is such a big deal. You have the edge there!
nedkelly · 61-69, M
@Handfull1 I can tell you most males like to see a lady dressed to impress, not some slag
Handfull1 · 61-69, F
@nedkelly it’s subjective tho. Neither of us are in an age category to know what the younger generations find mutually appealing. I don’t pretend to either!
@Handfull1 your hatred has made you unhinged and I'm disgusted that you cheapen all rape claims pretending to give credibility to this obvious rubbish. I have to wonder the kind of person who will use alleged rape as a political weapon 🤮
@Sarasmiles If there's any truth to that, then Trump will INSTANTLY win on appeal and instantly clear his name; probably get a mistrial too!

But wait, my research says Trump hasn't even FILED his appeal on his first loss to E Jean Carroll yet! Why not?? That loss was back in May 2023! What is he waiting for??

Well, maybe, it's like this. Maybe those points on that meme are a mixture of false & irrelevant. Maybe Trump doesn't have a strong case for appeal, but as long as he tells the cult one thing and drags out the appeal process, he gets the "presumption of innocence" within the cult, even AFTER losing badly.

Meanwhile, he'll keep fundraising from the cult and keep enriching himself off their gullibility. Sounds like a plan!!
Lila15 · 22-25, F
@Sarasmiles Since Trump’s counsel didn’t bring any of that up, maybe your information is fake.

She has ties to the entertainmemnt indusrty and the media going back many, many decades. She even appeared on the tv series "To Tell the Truth" in the 1960s (it would be interesting to know if she was the real person or one of the imposters lying to the tv panel).
She seems totally obnoxious on here.

Lila15 · 22-25, F
@Sarasmiles So what? Trump is even more obnoxious. The trial wasn't a referendum on her character, it was to determine the award for Trump defaming her.
@HoraceGreenley says
No way Trump would ever bang that ...
and
So he doesn't recall a blurry picture. So what.
Meanwhile, during a sworn deposition in 2022, Trump actually confused E. Jean Carroll with one of his ex wives.

In other words, E. Jean Carroll WAS Trump's type. Trump DID recall, and said E. Jean Carroll looked for all the world like one of Trump's ex wives. Trump said so in a SWORN DEPOSITION!!!

Can anyone say “sham trial”?
Sevendays · M
And you know these are factual? That's a real question not an accusation. I ask because I don't know what to believe from the media.
@Sevendays Excellent question. The sexual assault in the Bergdorf dressing room took place in 1996. The tweets, if legit, are from like 15+ years later, And how can a tweet from 2014 inform anything about a state of mind in 1996??

What is the context of the tweets? Is she advising other women about their sexuality, or is she reporting her own state of mind??
SunshineGirl · 36-40, F
Because they had not been included in the exchange of evidence pre-trial, therefore they were inadmissible. A very basic legal principle.
ronisme1 · 61-69, M
You have to submit evidence before the trial. It amounts to the fact that his lawyer did a shitty job
over and over and over and over and over and over and over ... Trump's response to any and all situations is to try to deflect attention away from his own actions

(he also tends to go off on long-winded, word salad tangents that literally having to do with anything, and/or are completely made-up and laughably ridiculous, as yet MORE distractions from his own actions, which is why he wants the opportunity to, e.g., baffle jurors with bullshit by giving his own closing arguments even though he is represented by attorneys — and why any judge with a brain doesn't fall for that kind of stunt and let him do it)

that, and always trying to DELAY everything endlessly

he never has any actual defense for his OWN actions

this clown literally does and says the same things over and over and over and over and over ... and his base never thinks anyting of it ... quite the contrary, his base are dumb enough to DONATE MONEY to someone who claims to be a BILLIONAIRE but would be glad to have some dumb trailer park supporter pay his bills for him, being the serial con artist and cheat he has been for decades

Incidentally ... blaming BIDEN for the E. Jean Carrol defamation SUITS (yes, more than one, because dumbass does not have the physical ability to shut his own mouth and thinks he is special / rules don't apply to him, typical of a petulant man-child) is an example of just how absurd his lifelong pathological lying is ... he didn't assault Biden, Biden is not suing him, Biden has nothing to do with these lawsuits that Trump brought onto himself, before either he or Biden were ever POTUS in the first place ... but a con man will naturally try to spin stuff for an audience which is not very bright, is gullible, and/or has a vested interest in him wimming something else (the election) other than this lawsuit, even though they know he is lying and BIden has nothing to do with this lawsuit
For the same reason he shut down trump repeatedly. Lies have no place in a courtroom.
Because they aren’t relevant to the case. Trump never claimed Carroll asked him to sexually assault her. So her history is irrelevant.

Let’s assume you have a bicycle that you lend to lots of people. Does that mean I can use it without your permission? If I steal your bike, does the fact that you’ve lent it to others in the past mean I didn’t steal it?

[big] 55 Retired Military Brass Say Trump Is Unfit to Lead [/big]
Fifty-five retired general and flag officers have released a letter condemning Donald Trump’s behavior toward women, calling him “utterly unworthy” of the Oval Office. “If given such power, Donald Trump would create a command climate intolerant of women and incompatible with a trained, ready, and honorable military,” the open letter said. “The American people deserve better than a misogynist in chief. Donald Trump’s behavior is antithetical to American values.” Among the signatories are retired four-star generals and three-star officers, as well as officers from the Navy, Air Force, Marines, and Army National Guard. The officers wrote that if Trump were elected, he would likely hinder the progress that has already been achieved on addressing sexual assault in the military. The letter was signed by former officers of both genders, including Lt. Gen. Walter Gaskin, Lt. Gen. John Castellaw, and Lt. Gen. Claudia Kennedy, who was the first woman to reach the Army’s three-star rank.
@Josh1454 It brings to mind a distraught Trump supporter some years ago who was upset that "He's hurting the wrong people!" A lot of the folks championing this man do not care about what is being done. They care about who is being hurt. If you are hurting the right people, they see it as acceptable. The right people to hurt just generally tend to be anyone with less power than themselves.
