Depends on the weeks of the fetus. After a certain amount of weeks, a fetus may be able to survive out of the womb. Many states have laws about this.. if the woman is 7 months pregnant, and is killed, it can count as two.. So this isn't as black and white as most of you here are debating.

@revenant There is no semantics. Fetus unborn, baby born. Those are the distict terms to separate the "born" from "unborn". If you think that it doesn't matter which development phase the fetus is at, then that's your own lack of knowledge, or acceptance.

Just one person.

A fetus isn't a person. As far as i can tell it possesses no qualities of personhood beyond having human DNA.
Many laws count it as 2 to reflect the violation of the mother's rights, not the fetus. The charge is placed on the involuntary destruction of the fetus which the woman intended and desired to bring to term. In short, you're murdering a child they wanted to have but the fetus itself is not considered a person.

So what we've established so far is that a fetus without a parent is not the same as person and since they lack a destiny, they're also not the same as a person.

@revenant My instinct... It's a difficult one. I believe a pregnancy involves only an embryo for the several first weeks, and after that a fetus develops. To me, a fetus has the possibility of life but can't be considered viable as outside the womb it would never live without extraordinary efforts. Late term pregnancy (last three months) and you're talking about a life that could be sustained with the right expertise.

So is a murderer taking two lives (in the case of 1st & 2nd term pregnancies)? Not in the sense you might hit a 10-year-old on a bike, no. But he/she is removing the possibility of life. If not for the killer's actions, the fetus would likely grow into a child, or that's the assumption. So if the law allows for two deaths, I'm fine with it.

That's the same reasoning i had. The double homicide reflects the violation of the intention to carry that fetus to term and have a child.
From the current point of understanding in most societies, two have died because the potential life has been terminated.
