I also must point out that your method contradicts tRump's Executive Order 14168 by basing the decision on developed phenotype while EO 14168 bases the decision entirely on genotype.

Your method also agrees with Aristotle, at least during the period before the person makes their choice. Aristotle (fourth century BCE) in Poetics 21, identified three genders: masculine, feminine, and “in between” (μεταξύ). Of course the in-between gender, even if it's temporary, contradicts EO 14168.

Since my goal here was to point out the flaws in EO 14168, I think we've achieved a meeting of the minds.
