Can he be tried for treason yet?
Not with a majority GOP Senate. They’re even okay with treason—if it’s supporting their agenda. 🙁

"The Cambridge Dictionary defines “insurrection” as: “an organized attempt by a group of people to defeat their government and take control of their country, usually by violence”

By that definition, there was no “insurrection” at the United States Capitol on Jan. 6, according to the FBI. Reuters reports:

The FBI has found scant evidence that the Jan. 6 attack on the U.S. Capitol was the result of an organized plot to overturn the presidential election result, according to four current and former law enforcement officials.

"Ninety to ninety-five percent of these are one-off cases," said a former senior law enforcement official with knowledge of the investigation. "Then you have five percent, maybe, of these militia groups that were more closely organized. But there was no grand scheme with Roger Stone and Alex Jones and all of these people to storm the Capitol and take hostages."

This report is a devastating blow to President Joe Biden and Democrats, who have attempted to make the existence of an “insurrection” on Jan. 6 a key issue in the 2022 midterm elections. Reuters does note that some “cells of protesters,” including members of the Oath Keepers and Proud Boys, did coordinate to “break into the Capitol,” but the FBI found “no evidence that the groups had serious plans about what to do if they made it inside.” "

"Treason" is a big charge. And there's a lot of wiggle room in what actually defines treason. My gut is that they'll go after crimes that are easier to prove. They're certainly loading up on the financial side. I'm sure they are on this side too.
As a nation we can never let this happen again. If there was ever a time to draw a very clear line in the sand, it's now.
@Ynotisay That time to draw that line was when Congress had the best chance they will have.....before Trumps dies......to end any and all control he had over the party by sentencing him in his impeachment trials to....."no chance to ever be in politics or hold an office again." When the Republicans in the Senate let him off....that simply gave trump a green light to really be a cocksucker and try a coup to declare himself dictator of America. If he EVER runs and somehow gets elected as prez again..........and knowing he has tried to overthrow Democracy once...........take your best guess what he'll try to do again while he has presidential immunity?

@anythingoes477 Well, I think you clued in the reality. It's the GOP. Pure and simple. Democrats did everything they could. In this case, I think the Dems are truly fighting for the future. They understand what's at stake. Where it seems like he's going to get nailed either way, because politics doesn't have a seat at the table, is with financial fraud. I see that as secondary. I want him to pay for what he's done.

@Captainjackass It's so freaking bizarre. But the part that really fires me up is how the beat their chests like they're strong. That's the real mind fuck for me. They're the weakest and it's become crystal clear. Hard to take.
The prosecution won't stick if a jury can be convinced that the government was elected through a "crooked" or "fraudulent" election, though, and with so many people polled still believing garbage like this, forgetting all other things that would have to be proved, trying Trump for standing up for the lies millions of Americans believe sounds like a really bad idea.

I get that it's not "right," and even that it's wrong and not the way the justice system ought to work, but if you think the capitol riot/insurrection/tourism event was ugly, imagine what will happen if Trump is put in handcuffs for standing up for the lies that millions of his supporters still believe.



On the bright side, though, I guess, if it comes to pass that you could sell this to a jury as treason, there would likely be no statute of limitations on it, unlike so many more plausible crimes Trump may have committed.

Has anyone been charged or convicted of the crime of insurrection as yet? It seems impossible for there to have been an insurrection with no insurrectionists.

@MistyCee insurrection is an actual crime distinct from rioting, disturbing the peace or trespass. If no one is actually charged with the actual crime of insurrection, then it’s hard to see how there could have been an insurrection. They’ve had a year to bring charges.

Take a couple of steps back from your excellent question to see the bigger picture: If, after all the public criminal conduct of the past 5 years by multiple operators (who shall remain nameless for the question) You CANT get criminal convictions with proper sentences attached, what does this say about the state of the nation as a whole?
