Yeah, it's stupid. I guess the logic is that abortion is supposed to be a choice by the parents, so if the woman is murdered, the choice was taken away.

So yeah, wherever we draw the line on when life or personhood begins, we need to consider things like this. That's why I think the question of late-term abortion is kinda a distraction.

@Elessar A miscarriage means that an embryo or fetus is incompatible with life due to a genetic issue. No one has intentionally or deliberately chosen to kill an embryo or fetus..

I'm neutral on the topic of abortion because I believe there's no right or wrong answer and it's something that will always be a matter of dispute regarding the morality of it. But that is a valid point.

I'm against the state forcing birth, and while I see the inconsistency, it doesn't bother me much as I'm also against murder.
Pro-Choice and Reproductive Rights don't really get to the issue when abortion is illegal. Forced birth by the state does.

@foldedunfolding I hadn't, but did some searching. There's a couple of concerning statements about fraud with documentation and alternative methods of abortion. The way procedures are done should obviously be well regulated and enforced. There were also some very late abortions, but that's what you get when early ones are banned in half the country and it takes time to get it elsewhere.

@TheEmperor that's a false equivalency, for starters because there's no big lobby to ban guns, only to regulate them. And people advocating for reproductive rights aren't asking for it to be unregulated.
Context. If I strap someone to a chair and fry them I am a murderer but if the state does it, it's justice.

Simple -- the double homicide charge can be used to punish the murderer to a greater extent and to inflame the passions of the jury.

The law is always trying to find ways to make crime XYZ the worst it can possibly be in order to get the maximum possible punishment. It was a tactic of those old tough on crime stances that just became part of the culture over time.
Cause if X person did the heinous crime of jaywalking, a tough on crime legal-ite could also hit them with public endangerment, wonton disregard for public safety, attempted insurance fraud and a good lawyer could say X was trying to commit suicide and thus slap on attempted murder of the self as well. Cause there are instances where people have tried to make suicide punishable by death.
It's all about maximum harm.
