what to do about someone smoking on oxygen

I wrote a question about this a couple of wks ago, a new guy that moved into my bldg is on oxygen and constantly smoking, and i mean constantly, hes outside from morning till nighttime, literally, ive seen him out the window and everytime i go somewhere and back hes still smoking, i know sometimes he might take his oxygen off but othertimes leaves it on, i did tell my apt manager about it and hes talked to him but thats about it, hes a fire waiting to happen, thought of calling the police but im afraid of people getting too mad at me for it and wasnt sure if they would do anything, who else can i report it to, im afraid of reporting it cause i might be facing angry people afterwards but what if he starts a fire, wonder what he'll do in the wintertime if he cant smoke outside, thought of the health dept, my manager is too nice to do anything about it, should i talk to the fire dept or whom, any suggestions? makes me paranoid that my smoke alarm might go off anytime,
For starters, make sure YOU have fire extinguishers and a plan.

You've spoken to your manager. No results.

Try reading your lease and see what it may say about fire.

Is your manager the owner, or an employee? Maybe you can get to someone who DOES care about whether insurance will pay if the building burns down.

Try the fire department. But when the smoker asks who told them that, don't count on their discretion.

Try writing letters. They seem more important than phone calls.

If you have to, move, although if the building permits smoking, there's no knowing if they're doing the same.

Have you tried speaking with him ? It may be futile but worth a try?? My mother was a very proud smoker and would not quit for anything ... including her four pregnancies.

If your manager is too nice to do anything about it I would contact your landlord or the people who own the building .. perhaps the people who pay for the insurance on the building? Inform them that this is a fire risk and that you would be more than happy to contact The Department of State's Division of Building Standards and Code.

@dontbekoi yes, he'll take the oxygen off if i say anything but if im not there or the manager aint there he puts it back on. also, he has parkinsons too and hes in a wheelchair, so his hand probably shakes when hes lighting up too which makes it worse,

@pearllederman Well even if he takes the oxygen tube off when he is lighting up and smoking it is still dangerous. And depending on what kind of regulator he has on the tank valve it can be just as dangerous as if he had the tube in his nose. There are 2 types of regulators - one puts out oxygen only well the person breathes in and out. The other type of regulator is called a Free Flow regulator - it puts out a continues flow of oxygen regardless if the person has it in their nose or not. Cheers!
your post kinda puts a sad note in my heart as my mom died a horrible death because of smoking. i'll spare the details but yes it involved her lungs and amputations. my guess is that person has little time left on this planet and i hope things turn out for you and your neighbours so you don't have to live in fear of your place catching fire.

@Soossie i just talked to my apt manager and told him hes outside constantly and always with a cigarette on his hand, hes outside like 12 hrs at a time, i know cause i see him constantly, i think hes only goes inside maybe to use the bathrm or whatever, i told him i think he dont take his oxygen off unless he sees someone. cause when i was riding the bus i know the driver and asked her does it look like he has his oxygen off and she said no, my manager said he was going to talk to him again, ive been letting him deal with it, people are more likely to listen to him than me

@smiler2012 He is an addict. He knows he is dying but cannot get off the cigarettes. He is not in a logical place.

@Mamapolo2016 well as i said smoking near an oxygen cylinder is very dangerous as it is pressurised container so he will meet his maker sooner than he anticipated if it blows

Well, this is really awful of me to say. But since he is smoking, and on oxygen? Just woke up casually stand out too far away and make small talk. Then grab the oxygen Tank throw it down the street
He is endangering you as much as if he were pouring gasoline on the Trash fire Maybe it would be a good idea to call the police there’s a guy with a bomb over here!

That really worried my mom. When my dad was alive and was using those oxygen tanks, she had to turn it off so he would smoke his cigars. There was always a deep concern that someone would forget to turn the thing off and he would have lit one.
@Barefooter25 It's crazy how these people's addiction takes precedence over any concern about safety.

I agree with LordShadowFire. You can place a non-emergency call to your local law enforcement (sheriff or police) depending where you live. Explain the situation and your concern.

If he was on his own land , in his own home, there is probably nothing you could do , he’s old enough to smoke and breaking no laws.

Where he is in an apartment you may be able to talk to the owners or manager if he is in violation of their rules but that is about all you can do in my opinion. Have a fire extinguisher ready or move is all I can think of.

Get a couple of those super powered water guns and use it immediately extinguish any lighters, matches, cigarettes and have everyone else do the same. Install cameras so the jackass can’t sneak off and blow you all up in secret. Cheaper than filing a lawsuit.

There is little point for him to be on oxygen if he is still smoking that much. He may just die of lung cancer or heart attack. Do not think police or fire dept can do anything. I have no doubt they will find him dead one day.

not much yuo can do. if the government is involved - like he's got a social worker you could let them know.

the only other thing you can do is make sure you have a fire extinguisher and know at least to ways out of your house.
Talk to the Fire Dept or Police. Will you be worried about making people mad when someone's dead or seriously hurt?
Carry around a fire extinguisher, and wait for him to light a cigarette in your presence.

well, he must be smoking outside so i wouldnt worry too much. hes been warned and hasnt started a fire so far...
It's an obvious hazard.

Mind your own damn business. Unless his room is totally full of over 21& oxygen and the is closed up it isn't going to catch fire. Go back to high school and study more.
Let them be mad, call the police, fire department, any government agency you can think of, even your local newspaper(s) and tv station(s) and radio station(s) if it takes media shaming to motivate the local government and property management company ... before your building turns into [i]Grenfell[/i] ... this guy does not need to be sharing a building with anyone if he cannot respect the safety of others, let him set himself ablaze in a parking lot, and himself only, people like tht do not need to be coddled or deferred to
Okay, before I give any suggestions, I just have to say I originally read that as smoking oxygen, lol.

Here's the problem. You can't police this guy. You know who can? I'll give you a hint. They wear badges. Will he be angry if you snitch him out to the piggies? Sure. But he is literally threatening the lives of everybody around him with his habits. You would literally be saving lives preemptively.
