what to do about someone smoking on oxygen

I wrote a question about this a couple of wks ago, a new guy that moved into my bldg is on oxygen and constantly smoking, and i mean constantly, hes outside from morning till nighttime, literally, ive seen him out the window and everytime i go somewhere and back hes still smoking, i know sometimes he might take his oxygen off but othertimes leaves it on, i did tell my apt manager about it and hes talked to him but thats about it, hes a fire waiting to happen, thought of calling the police but im afraid of people getting too mad at me for it and wasnt sure if they would do anything, who else can i report it to, im afraid of reporting it cause i might be facing angry people afterwards but what if he starts a fire, wonder what he'll do in the wintertime if he cant smoke outside, thought of the health dept, my manager is too nice to do anything about it, should i talk to the fire dept or whom, any suggestions? makes me paranoid that my smoke alarm might go off anytime,

Have you tried speaking with him ? It may be futile but worth a try?? My mother was a very proud smoker and would not quit for anything ... including her four pregnancies.

If your manager is too nice to do anything about it I would contact your landlord or the people who own the building .. perhaps the people who pay for the insurance on the building? Inform them that this is a fire risk and that you would be more than happy to contact The Department of State's Division of Building Standards and Code.

@dontbekoi yes, he'll take the oxygen off if i say anything but if im not there or the manager aint there he puts it back on. also, he has parkinsons too and hes in a wheelchair, so his hand probably shakes when hes lighting up too which makes it worse,

@pearllederman Well even if he takes the oxygen tube off when he is lighting up and smoking it is still dangerous. And depending on what kind of regulator he has on the tank valve it can be just as dangerous as if he had the tube in his nose. There are 2 types of regulators - one puts out oxygen only well the person breathes in and out. The other type of regulator is called a Free Flow regulator - it puts out a continues flow of oxygen regardless if the person has it in their nose or not. Cheers!
