The Oklahoma Senate passed a bill that would make illegal immigration a state crime.

House Bill 4156 makes “impermissible occupation” a criminal act, defined as a person willfully and without permission entering and remaining in Oklahoma without first obtaining legal authorization to enter the United States, according to the bill.

If signed into law, those living in Oklahoma as illegal immigrants would be guilty of a misdemeanor punishable by up to one year in county jail, a fine of up to $500, or both…

The bill passed the House last week.
It's sad that states must resort to these measures because the federal gov't refuses to enforce immigration laws.

Looks like they've wised up. Let's have a look at [i]Mexico's [/i]immigration policy...


Simply put, illegal immigration is a felony under Mexican law. In fact, Article 123 of the General Law of Population mandates that “a penalty of up to two years in prison and a fine of three hundred to five hundred thousand pesos ($17,000 - $29,000) will be imposed on the foreigner who enters the country illegally.”

*Article 126 – Any foreigner who “attempt against national sovereignty or security” will be deported from Mexico.

There are also penalties that will be imposed on Mexican nationals who provide assistance to illegal aliens in terms of illegally entering the country. These penalties will officially cause them to be considered criminals under the law and are as follows, per the General Law of Population:

*Article 127 – A Mexican who marries a foreigner with the intention of helping them live in the country will face a total of up to five years in prison.

*Article 132 – Fines will be imposed on any and all airline and shipping companies who bring undocumented foreigners into Mexico.

*Article 117 – Deportation orders that are not obeyed are subject to a foreigner being punished.

*Article 118 – A foreigner who has been deported yet attempts to re-enter the county without prior authorization faces a prison sentence of up to 10 years.

*Mexico Immigration Laws Penalties. Articles 119, 120, 121 – Any foreigner who is found to be in violation of the terms of their visa can be sentenced to a total of up to six years in prison. Additionally, foreigners who misinterpret the terms of their visa can also be imprisoned as well.

With Democrats flooding the country with illegals and putting their political opponents on trial (like what Putin did to his political rival), I wouldn't be surprised if Oklahoma, Texas and a bunch of other states say bye bye to the USA and the country simply breaks apart.

County jails are already full. About 25% of occupants in the Oklahoma County jail are foreign-born.

So either way the immigrants win. Since they would not be able to pay the fine, they'd take the year in jail. Free food, room and board, free medical and they're still in the state/country.

No room in jails and the 500 will be paid by taxpayers . It will end up costing taxpayers .How much is a plane ticket back to wherever the hell they came from?

That should make it easier when it secedes.

Seriously, though, we're living in very interesting Constitutional times as far as federalism goes, with immigration, abortion, EMTALA, 2nd Amendment, Elections, and state prosecution of former federal officials all being tested.

We probably haven't had this much uncertainty since about 1861 or thereabouts.

@MarmeeMarch That's a real over-simplification, especially if an Originalist Court decides to apply (or maybe revive?) the 10th Amendment and at the same time maybe reverse 200 years of court decisions on federal preemption doctrine.

The 10th Amendment says:

Now, while its pretty much been settled law that the Feds have the power to regulate immigration, the text of it only mentions naturalization, and all of the jurisprudence is based on [b]implied[/b] delegation, which pretty much runs contrary to the spirit of Orginalism, which isn't much concerned with the present or future welfare.


I don't much like it, but there's plenty of ways for a Court to, imo, pervert Constitutional law for political purposes, and, well, basically, cripple or dismantle the Union.

On the other hand, this might be a good case to point out the flaws in Orginalism or at least clarify that its not the only permissible approach to all interpretation issues.
