Should gun manufacturers be allowed to be sued when someone is killed with their product?

SW-User
No this country is too sue happy. Self accountability needs to make a come back

@QuixoticSoul what you have nothing to say now that I’ve nailed you to a cross you a pathetic piece of garbage you want to block me whatever I won’t miss you but don’t use another account to message me after you block me pretending you didn’t block me come on dude how lame is that shit and to entertain you farther I’m not pulling those numbers out of my ass you seen the article and regardless of the number in Vegas )which was just nothing but your way of whinnying) my point is still valid that at the time of the airport stabbing that had more casualties than any mass shooting in American history

@SW-User Chill dude, I was taking a shower.

An that is actually a neat experiment that I just repeated.

Tbh all of this raises more questions than answers. One of us shouldn't have been able to do that.

@SW-User The useful idiot gun control freaks target the NRA because they want to dry up the donations. But drying up the donations would not change anyone's vote, and it isn't changing anyone's vote now. They simply do not comprehend the situation, they just want, no need, to have a bad guy to attack.
Xuan12 · 31-35, M
Actually, do it in reverse. Give gun manufacturer's the option to sue people who use their guns for murder! XD
Backwoodsman2 · 70-79, M
@Xuan12 Sounds good
Zaphod42 · 46-50, M
Should car manufactures be sued for that too? Maybe peanut farmers while we're at it?
SW-User
@Zaphod42 don’t forget knife manufacturers. Those are the real threat in this world. China had more casualties in a mass stabbing than any casualties in a mass shooting in the United States. BAN ALL KNIVES
Scubaguy027 · 46-50, M
Depends. If the one shooting the firearm is killed due to a flaw in the weapon than yes.
If a gun is used in a murder no. You said it yourself-product. By that logic should someone be allowed to sue Ford if I murdered them with my Ranger? The reality is is that if someone has evil in their heart and they truly want to kill someone they will find a way.
Backwoodsman2 · 70-79, M
@Scubaguy027 Agree wholeheartedly
Ramon67 · 61-69, M
No . Because then you could sue everyone from car manufactures to drug companies even food suppliers because no one reads or adheres to warning labels . It should be about self responsibility .

Let's sue the automobile manufacturers when someone drives fast, drunk or run a stop sign or park illegally

Of course not. Someone makes a cricket bat. Someone uses said cricket bat to play cricket. Someone else steals said cricket bat and uses it to kill another person. How is the manufacturer of cricket bats financially liable for a murder committed by some one using a stolen cricket bat?
@hippyjoe1955 correct the only time it is bad is if the gun malfunctions or the bat is faulty
@Cow1919 I’m which case the person who killed can be sued and should be guilty of murder. But the sad thing is not everyone is convicted.
Atrevido1 · 61-69, M
No. Every maker of every product would be liable any time someone misused their product and someone was injured. Way more people die on the highways than by guns and no one is suggesting automakers be sued. The drivers, get sued and punished.
As I've said in another post, I'm not happy about the fact that gun manufacturers are immune by special federal statute from suits for foreseeable misuse, but...

The fact is, if you let juries decide the issue, the manufacturers would take some big hits, and guns would cost more.
@GunSmoke9 yup, and there are plenty of guns out there already as well
GunSmoke9 · 56-60, M
@MistyCee So why would want gun makers to take a hit knowing this would increase the black market, putting more cheaper guns on the street?
@GunSmoke9 that's an undesirable consequence for sure, but tbh, I have issues with legislation protecting selected industries from tort law that also weigh in.

@WindOfAdolf actually I am a firm supporter of the 2nd amendment. This question ties in with an idiotic conversation with a liberal Co worker. You could not be further from the truth
@WindOfAdolf thing is, all of those can be sued for foreseeable misuse, and sometimes it's not that absurd.

I worked on defending a nasty death case where someone tried to use a shop vac to clean up flammable materials. There was a warning on the box, but not on the vacuum.

The vac maker could be sued (although we won with the jury), but a gun maker has a federal law saying they can't be sued.
Once again, SW scoops the NYTimes

Certainly blows the 'Guns are tools' argument out the water.

No. That's ridiculous. A manufacturer shouldn't be ( nor is) responsible for misuse or criminal use of their product. It's a silly and absurd concept.
MarkPaul · 26-30, M
@MethDozer Well, maybe you do. But, I've studied it quite extensively and I think I know how it works, how to use it, and what it's capable of doing in the name of "true" justice.
MethDozer · M
@MarkPaul Shut up while you're sucking dick will ya?

@MethDozer Thanks for sharing your personal experience and first-hand knowledge.
