If Trump's executive order to save TikTok isn't actually legal, who would challenge it in court?

I doubt Musk or Zuckerberg are going to make much of a fuss. They want to stay in the good books of both Trump and China. I can't imagine any politician could match the legal funds TikTok would throw at a fight. So who?

It can be challenged all the way up to SCOTUS, but the executive branch controls law enforcement, so if as an official act he orders the ban not be enforced, what can anyone do? He’s immune from prosecution for official acts, no matter how illegal 🤷‍♂

No, not exactly. But definitely not clear either.

Most ordinary people really don't like what they think they know about the new rules on presidential immunity. Absolute power with absolutely no accountability makes anyone who values their liberty a little sick. And all the right wing maggots jacking off now over Trump 2 will be choking when time moves on, and someone they don't like starts calling the shots.

But what matters is, even with a shift in enforcement there actually is still no complete and total immunity for anything a President may do in every situation. The problem is that the Supreme Court, news reports, and especially social media have all done a shitty job explaining what the decision in Trump vs. United States really means in practical terms - or how it should be applied.

One indication of what's up is that special prosecutor Jack Smith did not drop all criminal charges against Trump after the Court's ruling in July. He amended them. He only withdrew the case after the election, when it was clear no Justice Dept under Trump would go forward.

So are there still some limits on executive privilege and Presidential authority? Yes, probably.

What are they? No one knows for sure.

Independent legislatures and judicial systems, with full authority to enforce or appeal all federal laws affecting citizens within their borders.

So-called "conservatives" have opened the door to endless litigation on virtually any part of Trump's whacked agenda, by playing games and setting precedent with immigration.

Get comfortable, and watch.
