Blue States Should Seriously Consider ALL Options to Disband Their State's National Guard Units.

Although every state has one, there is no federal requirement that they do.

And since Trump is repeatedly violating federal law by using such units to be deployed for domestic "law enforcement" duties, the governors of California, Illinois, New York and Pennsylvania (the largest states with Democratic governors) should consult with their AGs and legislatures and disband their state's National Guard units as soon as possible.

Since states have rarely needed their Guard units to quell domestic disturbances, those states can easily replace the duties of the Guard to help with natural disasters by other means.

That might not stop Trump from federalizing, say, Ohio's National Guard or South Carolina's. But Republican voters in such Red States will tire of Trump's tractics pretty quick due to the strain such deployments put on Guard members and their families when Guard members are sent to San Francisco or Seattle to plant flowers and pick up trash as they were doing in D.C.

Would work only for a short while. Please remember Trump actually had called the military in California, even if they did nothing.

In California the national guard also deals with fire situations.

@beckyromero there is a small question whether or not he will "terminate" the constitution.

Yet this close to the election if he hasn't already started doing anything it's not going to happen. So where else is he affecting the election? 🤷🏻‍♂

The South Carolina Circuit Court Judge who may have been the target of an assassation attempt earlier today:

COLUMBIA, S.C. (WCSC) - A federal request to hand over sensitive information from millions of South Carolina voters is now on hold.

Late Tuesday, Circuit Court Judge Diane Goodstein issued a temporary restraining order resulting from a new lawsuit challenging whether the South Carolina Election Commission will give voters’ data to the Department of Justice.

Earlier this summer, the DOJ told South Carolina to turn over the information of the more than 3.3 million people registered to vote in the state, including their names, addresses, birthdates, driver’s license numbers, and last four digits of their Social Security Numbers. Other states received similar requests.

The Trump administration badly wants state voter registration records before the mid terms so they can intimidate voters and work to order states to purge voter rolls.

@beckyromero That's outright corruption. Not actual gerrymandering like in Texas.

How you going to stop it? 🤷🏻‍♂

No national guard situation is going to stop it. Like any national guard would get involved in any way with preventing assassination of Democrats.

Wouldn't even happen with Republicans.

I am sorry. But you are still thinking like a Democrat. Acting like the law and the rules mean anything in America has got the country into the dire state you currently "enjoy".. Judges orders mean nothing to Trump or his people. But there is one way short of violence to stop him and the government shut down is the best possible time to employ it. All "donor" states to the US federal funds should simply halt all remitions immediately. Those funds should then be immediately employed for the benefit of those states. to insure they cannot be recovered later..Money is one sure way to get Trumps attention and he cant tie the matter up in court..Then each states national guard units will have a cause and territory to defend in the event of federal threats of force..😷

@whowasthatmaskedman

By federal law, National Guard units can be federalized for legitimate purposes. Trump's reasons are not legitimate, hence the push-back from the states and courts.

But if there in no National Guard in a state to federalize...

The funds that states use to pay and train their own Guard units can be redirected to pay for the things their own Guard units typically do in their home states, which is deployment to help with natural disasters.
whowasthatmaskedman · 70-79, M
@beckyromero And there is that word "legitimate" again. Trump and his pet republicans are just not playing withing the legitimate guidelines and if the Democrats continue to play that way they will lose..😷
beckyromero · 36-40, F
@whowasthatmaskedman

Hence the rationale for eliminating the Guard in state that Democrats can do so.

States cannot disband its National Guard without the consent of the U.S. President The National Guard operates under a unique dual-authority system, serving as both a state-level military force and a reserve component of the U.S. Army and Air Force.
the President can deploy the National Guard on U.S. soil, but the legal circumstances and level of authority depend on the situation and whether the governor of the state consents. Recent deployments and court challenges highlight the ongoing legal debate surrounding the President's authority to use the National Guard for domestic issues, especially without a governor's agreement

@pdockal
No, a state cannot unilaterally disband its National Guard, even if federal funding were to be cut. Federal law, specifically 32 U.S.C. § 104(f), requires the President's consent for the disbandment of any National Guard unit whose members have received federal compensation.

What did I say?

U.S. Code
TITLE 32—NATIONAL GUARD
§104. Units: location; organization; command

(f) Unless the President consents—

(1) an organization of the National Guard whose members have received compensation from the United States as members of the National Guard may not be disbanded;

If the state doesn't receive compensation from the federal government to pay its members, the state can disband their National Guard.

And for a California law reference:

Military and Veterans Code - MVC
DIVISION 2. THE MILITARY FORCES OF THE STATE [100 - 567] ( Division 2 enacted by Stats. 1935, Ch. 389. )
PART 1. THE STATE MILITIA [100 - 491.3] ( Part 1 enacted by Stats. 1935, Ch. 389. )
CHAPTER 3. The National Guard [210 - 270] ( Chapter 3 enacted by Stats. 1935, Ch. 389. )

ARTICLE 1. Membership [210 - 217] ( Article 1 enacted by Stats. 1935, Ch. 389. )

210.

The National Guard consists of:

(a) General officers.

(b) The several staff corps and departments prescribed in tables of organization of the United States Army or United States Air Force or tables of organization for the National Guard.

(c) The officers and enlisted persons on the retired and the reserve lists.

(d) The organizations forming the National Guard and persons enlisted or commissioned therein.

(Amended by Stats. 2018, Ch. 118, Sec. 3. (SB 1501) Effective January 1, 2019.)

211.

The Governor may alter, divide, annex, consolidate, disband, or reorganize any organization, department, or corps and create new organizations, departments, or corps when required by the provisions of this division or whenever in his judgment the efficiency of the State forces will be thereby increased.

Your a joke... I'm sure you'll just block me

Wish granted since you made it personal.

Buh-bye!
Didn't I just hear something about calling in the 82nd Airborne?

It might help, but in the long run, I think it's more likely that resistance would be crushed by other means and the National Guard thing is more of a symbolic thing.

Interesting idea.
3Dogmatic · 46-50
National guard is regularly used domestically. It’s in the name…
3Dogmatic · 46-50
@beckyromero you are correct, a state is not federally mandated to have a guard unit. However, the state then loses out on federal resources for emergencies and disasters. Hence why the states and territories all have national guard units and will likely always have them. There is also no abuse of the National Guard happening.
beckyromero · 36-40, F
@3Dogmatic
There is also no abuse of the National Guard happening

That's your opinion. Tens if not hundreds of millions of Americans would disagree.
3Dogmatic · 46-50
@beckyromero and that’s the beauty on the US, everyone gets to have their own opinion and vote.
Blue states should secede and form their own country. If CA, Oregon and Washington would band together, they could control 80% of the imports coming to this country, then triple the charge to anything going to red states and starve them out.

@whowasthatmaskedman Is he the Manchurian Candidate?
whowasthatmaskedman · 70-79, M
@samueltyler2 No.. Nothing so organised. If you ever saw "Petes Dragon" he is the snake oil salesman who came to town and spotted an opportunity. Or if you like the lead in the Music Man. Again, a con man who takes advantage. Of course, he is being played by people like Steohen Miller, who have an agenda for control of the US under a different regime after the crash..😷

the one leading, you are the sheep in back wearing blue hats who lost thier way, a ram will find them, and then you all will get screwed

The leader, huh? Didn't know Il Duce was even on SW.

Although there is probably some law against impersonating the president.
