Judge orders Venezuelan man wrongfully deported back in the US by Monday

Govt provided no documentation that he needed to be arrested, Trump administration admitted error and Trump wanted Venezuelan man to remain in prison by saying that there's no way to bring him back. Judge ordered his return by Monday midnight.

The Atlantic published a deportation sob story about Kilmar Abrego Garcia being sent to that notorious El Salvador prison. The Trump administration admitted an “administrative error” which caused the problem. The Atlantic played up the fact that he was a “Maryland father” who shouldn’t have been deported because he was under temporary protection status. They left out some important information. As they usually do.

The government filed a report with the court admitting their mistake about sending Garcia to El Salvador, so The Atlantic jumped on it hoping to once again give Donald Trump and company a black eye. But they failed to note that the judge who ruled in his case in 2019 did say he could be deported, just to somewhere besides El Salvador. The mistake? He was sent back to El Salvador instead of that other country.

“I just read the court filings to get the full context (which may not satisfy either side): The man is an illegal migrant from El Salvador. In 2019, ICE presented sufficient evidence that he was a member of the MS-13 gang for an immigration judge to deny him bond and order his removal. However, he then filed an asylum claim and obtained a withholding of removal order under the convention against torture. Essentially, he argued that despite his being here illegally and likely being a gang member based on the previous finding, he could be tortured if sent back to El Salvador. Such an order could still allow the government to deport him, but not to his home country, at least not without first contesting the order. He has been using that order since 2019 to avoid deportation. With that context, referring to him just as a “Maryland father” obviously does not tell the full story. And The Atlantic reporter cites the lawyer to downplay the previous finding of MS-13 ties.

@sunsporter1649 The man was denied due process. Read the 5th Amendment.

The Fifth Amendment says that no person shall be deprived of "life, liberty, or property, without due process of law."

This man's due process rights were violated. That's a crime; no ifs ands or buts.

Was that back in the days when you loved immigrants from Cuba and would grant them asylum at the drop of a hat???

Some will try to "enforce" and "refer" to the old "laws". Takeover. You have allowed a coup in the oval office - but contrary to predictions?- the revolution was on TV! Everyone watching the Elon show. And the reaction is as always. Americans were never a country so they have no ethics and no response. Nothing. Let it be okay no matter what happens to them - remember - nothing! Nothing!

I would like to see the teeth by which the courts intend to enforce that on a president who shows nothing but contempt for the rulings, and who was granted immunity for any crimes that were official acts 😕

At least the Trump administration admitted their error and are correcting it instead of trying to blame someone else.
Unlike the liberals, democrats and extreme leftists who put the blame on Trump for every screw up and failure they have.

@IM5688 They weren't trying to correct it, a judge ordered them to correct after the Trump regime said they couldn't get him back and he was gone. It's because of that judge, who Trump says are activists and shouldn't be listened to, that the man is even coming back in the first place.

And that's if Trump even obeys the judge, he didn't the first two times a judge told Trump to do something. I pay attention, if you think you're going to do that, you will lose
