Trump Takes the Fifth. Over and Over.

Trump had his deposition earlier today about his business dealings. He invoked the 5th on all questions. Came out of the deposition holding his fist in the air. Like a political prisoner. Here's his statement about why he took the 5th.

“I once asked, ‘If you’re innocent, why are you taking the Fifth Amendment?’ Now I know the answer to that question,” the statement said.

There was a little more to it when he went after people taking the 5th in 2016.

“So there are five people taking the Fifth Amendment. Like you see on the mob, right? You see the mob takes the Fifth. If you’re innocent why are you taking the Fifth Amendment?”


Perfect.
He’s said a whole lot of things that have come back to bite him in the behind with a vengeance, hasn’t he ? Yet his supporters never seem to remember or somehow claim the media “misquoted" him.

@bijouxbroussard I just read that he signed a law in 2018 that changed the penalty of unauthorized removal of classified documents from one year to five years. Turned it in to a felony. He did that to serve the whole "Lock her up" bullshit around Clinton. And now it's come back around. Perfect.

LOL!!! If Trump is innocent why is he taking the Fifth Amendment?

One additional interesting point: Trump's deposition is for a civil case. And in a civil case, in some cases the other party is allowed to treat taking the 5th as a sort of cover-up:

In civil litigation in federal court, a witness’s invocation of the Fifth Amendment may give rise to an adverse inference “when independent evidence exists of the fact to which the party refuses to answer.”

“Once a witness in a civil suit has invoked his or her Fifth Amendment privilege against self-incrimination, the trier of fact is entitled to draw an adverse inference from the witness's refusal to testify.” Chaffee v. Keller Rohrback LLP

@Ynotisay I don't think that it was a surprise that he took the 5th "on the advice of council" using the legal system and the law to protect himself. Calling it a 'Witch Hunt" is also typical of 'always the victim and everyone is being mean and unfair to me', sounds more like the lyrics to a sad 'country music song'. What I do find offensive is that in the past he has bragged about being a Muti Billionaire and has asked for donations, again, to his civil lawsuit.

His answers could be used in a criminal proceeding.
His cult will bail him out of civil fines.
They can't do time for him.
Should the 5th Amendment apply to civil proceedings?

It generally doesn't historically, but my guess is, you could craft an "originalist" argument that it should, if you pick and choose your historical evidence in search of the intent behind the 5th Amendment.

@Spotpot Sure, but let's face it, he's only at risk for money in civil proceedings, and he can still fundraise from folks who think he's wrongly accused to pay for it.

Pleading the Fifth makes sense, as long as his his supporters don't mind it, and my guess is they won't.
