Anyone else thin CNN and Jim Acosta's lawsuit that was filed this morning will fail?

This is not a freedom of speech or freedom of press issue. Being allowed access to Presidential press conference is a privilege not a right.

@GJOFJ3 They could, and personally, I think Accosta is a pain in the neck, but there's a pattern of attacking CNN here, and not just Acosta. But canning him wouldn't stop Trump from calling them fake news or abusing other reporters.

I really don't know who's going to win this one, but I don't think it's a no brainer legally, and I can't blame CNN for standing up for itself and what it thinks is an important constitutional issue.

In fact, I kind of think it would be unpatriotic and immoral not to stand up and fight over this one. Plus, like I said before, Trump's prior conduct, and the doctored/sped up video makes this a good case for a private business whom Trump has abused to fight back.


Most of his victims won't, or can't, like the NFL, but individual suits are growing, along with some competitors in the emoluments cases, and I expect, eventually, we might see at the very least, counterclaims from ATT, Comcast, and some of the tech companies if he ever can get the DOJ to file his frivolous AntiTrust actions.

Resisting Trump in the Courts may ultimately be futile, but I think it's important that it can still be done.

I might have gone too far with this line, tbh. I don't think I'm wrong, but it's a more general thing than just about this case, and CNN is a corporation, which really is sort of inherently amoral by nature.

It's pretty hard to fight the video that showed Acosta accosting a white house intern by laying his hand on her to prevent her taking the mike. So I do think their foolish lawsuit will fail.

@MistyCee In the end, video or no, the intern can be called as a witness and can file a complaint of her own if she so chooses.
@4meAndyou she could, but it's all but irrelevant to the rather juicy legal issues, and I doubt it will come to that.

If Trump doesn't cave, my guess is theyll go after Accosta for his speech by tweet and in the press and not push that poor intern into filing a civil suit while fighting the 1st amendment stuff in court.

Who knows who's going to defend this, given the screwed up mess in the DOJ with Trump, but I'd guess a smart defense attorney would not push for an evidentiary hearing and try and get the suit dismissed on the pleadings.

@4meAndyou It sure would be nice if we had a media who actually understood government, the constitution and what rights we/they have. Said reporter has no right to report from the WH. Actually, neither does cnn. I can guarantee you this will fail.
Depending on the judge, I think there's a decent shot they'll get relief from the district court, and a better than decent shot the DC Circuit would affirm. I'm not so sure about the Supremes, though, which is where this thing is going to end up unless the Trump administration backs down.

I'm really kind of conflicted on this one. i think CNN is doing the right thing by filing the suit, even though Accosta was being a jerk, but they're taking a big risk, because if they lose, at any level, the Trump administration will likely declare a victory and a judicial mandate to bar access to the White House from anyone who doesn't swear a loyalty oath.

Acosta could sue for defamation. The White House falsely accused Acosta of assault by sharing a doctored video claiming so to justify banning him.

@MasterLee if that was the case Trump would be sued many times for being one. But you can’t sue someone for being a moron.
Politics aside!!! Acosta has been pushing the limits of decorum for sometime. He is rude and a bully. I know everyone wants to make this about Trump, but it is about time Acosta got put in his place.

@Picklebobble2 this isn't new though mate. Check out Carne Ross' account of how the media is handled in the foreign office.....don't tow the official line then you're out. This is slightly different circumstances as it's accusing someone of assault (if I've got the right reporter?)
