Is Trump legally barred from running for President again by the US Constitution?

I believe that a president is only allowed to serve a maximum of 2 terms.

Ah yes there it is - the 22nd ammendment ratified in 1951.

From Section 1:

"No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once."

So unless Trump changes it, he cannot stand for re-election as GOP candidate in 2028.

fanuc2013 · 51-55, F
@Nevertooold Do you seriously think that will go anywhere even IF it was true? Don't be ridiculous!

Yes, he's barred, but he proved that he will ignore the Constitution, because Congress will not hold him accountable.
it is to my understanding as long as america is at war they can't have an election so he stays in power should the war continue

No person shall be elected

Emphasis added.

He would still be eligible to succeed to the presidency from vice president, speaker of the house, etc.
KimberKimKim · 31-35, F
@beckyromero yes he could through those avenues. He wouldn’t though.
zonavar68 · 56-60, M
@beckyromero As for 'elected', in terms of the president it means the first past the post to get 307 or more electoral college votes. The people do not directly elect the president - the electoral college members so. The voting public just guide their state's electoral college members on how they should vote to determine the next president.
Ha! Legally smeegally...

Yes, but it doesn't matter. The Constitution also says someone who took part in an insurrection can't hold office.

The Constitution is just a piece of paper. The words on it only matter if we have people in government willing to enforce them. But we have Republicans who are fascist, and Democrats who are unwilling to fight back. So here we are.
fanuc2013 · 51-55, F
@BohoBabe Will you make a bet with me if Trump runs again? If I win you donate $1 to the RNC. If you win I will donate $100 to the DNC. You haven't got the guts to take my bet!
BohoBabe · M
@fanuc2013 I don't think he will run again, I'm not even sure he's going to finish his current term. I'm just saying the Constitution doesn't matter anymore. If Trump did run again, the Republicans would nominate him again.
You lost me at "legally".😷
MoveAlong · 70-79, M
He's said he doesn't know if he actually has to obey the Constitution. I believe he went into this term planning to stay. I believe he will deteriorate so much mentally and physically in the next two years that he won't be able to anyway.

@MoveAlong Add this to the long list of things Trump doesnt know..😷

You are correct! And anybody that says differently is just a fear-monger, Trump hater, or just an ignorant leftist that is repeating some ridiculous mantra they heard somewhere. Trump.will be President until 2029, at which time a new one will be sworn in.
MarkPaul · 26-30, M
He can't change it. He doesn't have the cards. He can't even stay awake.
