Heart broken

I was in a car accident the end of Sept. The guy rear ended me going 70. I didnt have as much damage so i thought maybe my car was fixable. My windows were even still intact i was even able to open my trunk. Just found out today that my car is totaled. Apparently i was hit with such force that half my frame is shattered all the way up to the back seats. The guys said hes never seen anything this bad. Now im stuck in this crappy rental and have to look for a new car. What is a good suv replacement that will not cost an arm and a leg? I literally cried on the phone. This is my favorite vehicle. Its the only one I've ever found with a camera on the passenger side mirror. And i have to find a dr to re eval me. My back pain has gotten worse. I think the ER should have at least gave me scan but they didnt.

I'm so sorry to hear of your accident. You should definitely get reevaluated by another doctor. You got hit hard, there's no doubt about that. My advice is to consider the same vehicle again, seeing as you liked it so much.

@Sapio i would but only the 2015 model has the side camera. And haven't found one with less than 80k miles on it. I got lucky with mine. Bought it with 32k miles on it. In 5 yrs, i put over 120k miles on it.

@IceQueen88 80 kmiles isn't much for a modern car. Isn't much for any good car built in the last sixty years really. Or are US ICE vehicles so much worse than European ones? My 1965 Volvo Amazon that I scrapped in 1984 at 350 kMiles was in perfect working order despite the previous owner rallying it, we just wanted a more modern and more comfortable car. So we bought a 1976 Volvo 245DL with a 120 kmiles on the clock that we kept for twelve years and added another 130 kmiles.

I now have a 2015 Tesla S that has done nearly 150 kmiles and seems to be in near perfect condition. The battery did fail though but that was inside the warranty period so it was replaced at no cost.

Almost any severity of damage to modern cars is repairable and totaled is when the repair cost estimate exceeds the appraised cost of purchasing a similar or identical mileage make and model with whatever options the car has.

Since it was the back of the car that was damaged your low mileage engine/driveline is probably as usable as it was before the person crashed into you.

Most insurers will sell you back your totalled car for its scrap value if you tell them you want to keep it for the remaining good parts.

Then you can find another exact same year as yours with a southern rust free chassis but higher mileage that you could negotiate a very inexpensive price to buy and have a mechanic place your driveline into that one.

The cost of swapping out the driveline and buying your wreck back and another car like your own should be in the vicinity of your insurance settlement plus or minus by a small amount.

I wouldn't talk about that to the person who said your car is totaled. He may be jockeying to buy your wreck to get his mitts on your low mileage driveline. Talk to someone you already do business with for vehicle service and ask them their fees to switch the engine and any other things in your car, black leather seats, etc.

There's a solution. You just haven't been told it by anyone. And the body shop not suggesting it seems a bit lazy in my opinion.

@IceQueen88 It doesn't matter if you make the arrangements to store your wreck at your mechanic's yard at where you live. You can contact a car trailering or flatbed delivery service. It doesn't cost too much to have any car loaded on a flatbed and delivered. Running or not. Car collectors and restorers have old wrecks brought from anywhere to anywhere every day. It's just another lesser known aspect of the car trade.

No legal expert here but something to consider -
If you do have to get an attorney involved, they will likely get you more money than his insurance is offering BUT they might charge so much that by the time all is settled, you could end up with less money than if you took the insurance company's offer.

I do not know this for fact but it IS something to investigate. Meanwhile, do not sign any forms from his insurance.

For the vehicle, someone on here suggested buying back the wreck and having the good parts put into a different vehicle of the same make and model. Yeah that would get expensive REAL quick and take God knows how long. Plus there wouldn't be any guarantee of longevity of a vehicle that was franken-rigged.

Personally I cant speak highly enough of the Mitsubishi Outlander.. A little on the larger side. Most have 7 seats (I have never needed it) options of two wheel and four wheel drive and one of the few Japanese cars still sure to be made in Japan.. If you want a down side. They are not exciting. They just keep going as long as you maintain them and everything just works..😷
I hope you were fully insured and that your company can recoup the costs from the driver who ran into you - including costs for back care/physio.

I'm not an SUV expert but I once owned a 2001 Toyota Landcruiser and I can warn never buy that particular year of that model. It had a unique program for its electronic locks, which meant that when I lost both keys I had to pay $1600 for a locksmith to buy the program from Toyota so that he could reprogram a new set of keys. That program was only ever used for that year of that model - too rare to be worth it for most locksmiths.

@hartfire yes i was fully insured. I had 1 more month until i paid the car off. I'm hoping to get everything paid for by the other guys insurance.

Oh wow i well definitely add that to the list of vehicles not to buy.

i wish i could help you with your car, i was so stressed when i had to get my 2nd car from a dealership
Time to get a good "accident attorney".....

In fact, you should have done this the day after you were hit.....

I blasted a ceappy little car all to hell a while back. Wasn't much left of it. Spent a couple months in the hospital after that. Had a great time in the hospital though. Food was fair, nurses were great. Missed them when I left. One phyical therapist lady wanted to date me, pissed off some of my family members. There's more metal in me now than is left on that car though.

Go see an attorney. Believe me, a good auto accident attorney will jump on the injury issue and you money and new car issues won't be an issue. Sign nothing from your or their insurance company until you get a lawyer.

I’m guessing your insurance company will pay you the value of your car since you weren’t at fault? Same thing happened to me 6 years ago but the guy wasn’t going 70

They'll pressure you for a long time to sign that form. Don't sign it! If you have back pain, you really need to contact a lawyer for this one because the insurance company only wants you to sign off from this accident so that they are off the hook. 10k in damages won't last you a month if you have serious issues.

@swirlie yes I've gotten a call about getting it signed twice already. I won't sign it. I can't afford a lawyer since i spent 2k on rental car before insurance company finally took over.

You won't be paying for your own lawyer anyway! That cost will be paid for by the insurance company of they guy who ran into you!
