Seems to be unconstitutional but with the COVID-19 situation things become a bit more complicated.

As the large-scale studies that have recently surfaced show, there's been no marked increase in the number of Covid cases traced back to protests. LOTS of evidence showing that public gatherings in bars, beaches, churches and homes have driven new cases.
