I Need to Rant

I am a salaried employee, but my "shift" is technically 8:45 to 5:15.

I RARELY take lunch unless I need to run to the bank or something. (my boss had remarks about me taking a 30 min lunch daily so I stopped doing that long ago)

I have not left before 5:30 in ages. I usually leave at more like 6. (my boss used to comment that I "act like an hourly employee" when I would leave at 5:15 every day so I stopped doing that)

I am not usually late but yesterday I was 15 mins late due to traffic and this morning I was 30 mins late due to traffic and needing to scrape all the ice off my car. I also have to drop my daughter off at school in the morning, so I am not able to leave any earlier.

My boss had the nerve to walk in here and tell me today, with quite the attitude, that I need to "watch my time" because I was late yesterday and today. All I could muster up to say was "Sorry", but here's what I actually wanted to say:

Dude, I am salary and should not even have a "shift". I do not punch a clock. I do not get paid overtime and I put in at least 45 hours a week, even though I am paid based on 40 hours of work. I have not gotten a raise in two years and I have been with the company for thirteen. I have absorbed the FULL position of SEVEN PEOPLE in my time with this company without relinquishing any of my own responsibilities, and I still get my work done. How are you going to lord over me about my start time for two days, when I stay late EVERY DAY? Go drink bleach. *spit*

First of all, salary or not, it is a law that you get at least a 30 minute lunch break during an 8 hour work day. Which brings me to my next point, 8:45 - 5:15 is 8.5 hours, which where the hours cut out for you to be able to take you 30 minutes lunch. If you aren't planning to take you lunch then you should start at 9:15 and work to 5:15, if he doesn't like it then maybe he wants to challenge the state over it. Start keeping a log of your hours worked, especially if your working past your scheduled time. It makes it a lot easier to make your case when you finally do snap and throw it in his face. I'd love to have an ethics conversation with your boss.

I actually have to send her a spreadsheet everyday of my arrival time, departure time, and what I am working on for the hours in between, so I already have a good log of my hours worked.
Also, when she complained about my taking lunch daily, I went to HR and asked them if I have to take lunch and she told me no. I don't know if NJ laws have my back on this.

It would be best to look into but just because HR told you that you DIDN'T have to take it doesn't meant that you can't. If you are unable to take a 30 minute break once a day, then I say you need to start researching some place that is going to respect you as a person and an employee. I don't know what you do but I'm sure if your employer found out that you were planning on leaving, they would undoubtedly rise to the occasion and suddenly allow your lunches again. Then take their time and break you down again. Fuck them, hit 'em where it hurts the most!

You do need to say all this.Then act on what you said.Does your boss set an example and work extra hours for free?

She works all hours. Weekends, nights, travels internationally. But she also has no family and makes 6 figures. Her whole life is work. Also, she keeps HR as her best friend so I'm afraid to go there.

This person needs to learn the rules of exempt vs non exempt.

In my opinion, you can freak them out by asking them to put the statement in an email and send it to you. "Could you send me that in an email?"

They know EXACTLY what you are doing when you ask that and they will figure out if they are right or wrong.

I bet you work harder than he does. You left that part out of the rant. Often these things come down to retirement benefits otherwise people just get another job when they have a boss like that.

I'm not sure about that, actually. She travels internationally, works at home, on weekends, at night. She's a Type A personality. Never married. No kids. Lives alone. Work is her life. But she doesn't adhere to a shift and I have a family and things to do other than work.

Yeah, I agree with InjectPositivity. You sound like an intelligent hard working employee. I would dust off my resume and look around. You are still young enough to make that change.

Consistent tardiness is problematic. Hazardous conditions must always be considered by employers. You made the extra effort and made it. Keep up the good work!

Yeah I have to agree. But I also understand that sometimes its not easy to just up and leave without already having another job lined up (especially having a kid).

I used to have the same problem, until I pointed out that I work between 45-50 hours a week, always get my work done, and am always willing to take on more.

Also.... refer back you your employee handbook. It should explain the hours. If you have questions... ask HR but don't say why you are asking. You just want clarification.

Because I have a family to support, make good money, have a fully vested 401K, cover my family's medical benefits, have tons of PTO accurued for when I have to take off for my kid's school breaks or if she's sick, and also I am good at what I do, am comfortable here and enjoy my job aside from this one mental person.

I was doing that, but she started piling work on me and I am afraid she is doing that so she can write me up for not getting my job done. I've seen her do it to other people.

A lot of of fucking nerve, your boss... It sounds like it's time to find a new job. I know that's easier said than done but you don't need to take that bullshit. You should have told her straight-up why you were late. Even if she doesn't care to hear it, at least she can get your point that some things are simply out of our control and no one can help that. I would bet my car that she's been late for work plenty of times in her life.

And you don't need to stay 45 minutes after your scheduled time to leave, especially if they're not paying you overtime! If your boss doesn't like it, that's a whole lot of her problem. What's she going to do, fire you for leaving when you're supposed to?

She's good at twisting things. She has written me up for shit that she made up. For example, if we have a process that goes like this:
1. Open mail
2. Note account of mail type received
3. Route mail to department that handles
We could be doing this process for years and she will swoop down one day and say "Why aren't we scanning the mail to the account?" and I will say "We've just always followed this other process." and she will say "What if the mail doesn't get to the correct party and we get sued because we didn't respond?" Then she will write me up because I didn't think of scanning the mail to the account and did not keep the procedure updated.
So there I just got written up because I didn't think of some arbitrary shit that she thought of, and when you're working that way there will ALWAYS be something she could think of that I didn't already think of.
And no one above her will complain because she uses the "We could get sued!" or "This impacts revenue! This is what is keeping the company going!" lines.
It's a no-win situation.
