It’s hard to say. It’s too big of a coincidence for her to have a history of doing meth and he lied and just happened to guess the right drug.
My guess is he probably did something wrong and knew it so thought it was in his best interest to let her go. Possibly an illegal search which in that case he can’t use the meth as evidence against her.
He was probably interrogated her for 2 hours trying to get her to admit fault so he could arrest her and she didn’t. He definitely was using intimidation.
Your friend might have been sober and the cop found an old meth pipe that she forgot about.
She needs to understand how her rights work.
DarianPaige · 26-30, F
@Dom987654321 didn’t give it back to her until the very end. I was already there to pick her up & he was taking pictures of her ID so that he can “come to her house to arrest her if he finds anything against her today” 🤣 He gave it back to her right before he left
Dom987654321 · 51-55, M
@DarianPaige that would explain why he let her go. He was illegally detaining her. She needs to go file a complaint against him.
DarianPaige · 26-30, F
@Dom987654321 thank you!! i think shes gonna first thing Monday

He had no probable cause to search her vehicle or detain her and violated her 4th and 5th Amendment rights. She was not arrested or Mirandized, so anything she said would be considered inadmissible. He was off duty, and all police protocols require that he phone it in (since it was a nonviolent situation) and get active-duty officers on the scenes (since they have body cams) to investigate. She needs to hire an attorney and go after the police department and the off-duty officer. A blood test determines if she has been using. Residue means nothing other than it was there, and since the officer violated so many other protocols and constitutional rights, her attorney could allege that the officer planted the "residue" to detain her illegally.

@DarianPaige like I thought. He let her go because he knew it was an illegal search. If any of this was caught on camera she might need to go to a lawyer. She may have a possible lawsuit. If he searched her body and it was caught on any camera she will probably have a very good lawsuit.
DarianPaige · 26-30, F
@Dom987654321 only the first 5 minutes were caught on camera … we do have the part where he says “I was in bed asleep with my wife when I got called to come here, this is my off day” etc.. idk if that’ll be important to a lawyer or not. I don’t think he searched her body, he just searched the front part of her car & her purse. Idk why she quit recording. & idk if the camera outside of the store works or not! I hope it does.
Dom987654321 · 51-55, M
@DarianPaige it’s important to always record it so she can prove it happened. Without it he will just lie and deny it. But she should still go to a lawyer. She might have a case but probably not.

He didn't find anything but residue
Didn't think she was in the right frame of mind so he had her get a ride

All good from what you've told me

Your past doesn't go away and you'll be judged by it till you prove otherwise
Lilnonames · F
@DarianPaige residue is like having money that turns up positive for cocaine. But really no evidence
@Lilnonames I like the money example!

I just looked it up, the typical $1 and $5 pass thru about 110 hands per year; a $20 passes thru 75 hands per year. I don't know how long drug residue persists, and how much transfers to adjacent bills in a wallet or cash drawer, but surely after 5 or 10 typical uses of a bill, it's probably not rubbed clean.

So yeah, a small amount of residue in purse doesn't tell you much at all about where the residue originated.
DarianPaige · 26-30, F
@ElwoodBlues thank youu!!!!
Confined · 56-60, M
Residue generally does not hold up in court. There is residue of cocaine and other things on all money.
DarianPaige · 26-30, F
@Confined thanks!!
Muthafukajones · 46-50, M
Always ask if you are under arrest. If not leave.
DarianPaige · 26-30, F
@Muthafukajones he said she was detained so could not leave
Muthafukajones · 46-50, M
@DarianPaige then you stop talking and sit down. Ask after awhile if you can leave. That’s all you say. You ask for a lawyer too. You ask for your phone call. You say nothing else.

Not on duty with a trainee? Interrogating and searching a veh. for narcotics? Pure Bull. Did not happen, period.
bowman81 · M
@DarianPaige That story is either a fairy tale or the "off duty cop and trainee" were imposters. Think about it. If he were called out of bed by his department he would NOT have been off duty? The department also called in a trainee? Not hardly! Overtime is expensive. If it was the police there will be a report. If it was the police, and it happened anywhere near like what you said, they won't be officers for long.
You are getting only part of the story.
DarianPaige · 26-30, F
@bowman81 also when he searched the vehicle he half assed searched it, only searched the front part of her car.. and half assed did it, she said she thinks he half assed it bc he knew he really didn’t have probable cause .. this was a small town & the whole interaction seemed very off & illegal. I’m dumb and young and don’t understand any of this which is why I made this post.
DarianPaige · 26-30, F
@bowman81 I think the person that called probably called this officers cell phone or something… bc it’s a very very very small town. I think he called his personal phone but honestly I don’t even know. I’m just tryin to get other peoples opinions. My family member said it all seemed very illegal and she wants to look into suing
in10RjFox · M
Looks like she was not caught while driving the car. Dozing of on duty is no crime. He cannot order a drug test on just anyone based on doubt unless there is some misbehaviour causing nuisance.

So the officer has no case.
DarianPaige · 26-30, F
@in10RjFox thank you!! We’re going to try to sue them bc it was all illegal it seemed… he didn’t have a uniform on, no body cam.. the only footage is the 5 minutes that she recorded before she turned the camera off. Wish she kept it recording.
DarianPaige · 26-30, F
@in10RjFox this was in a veryyyy small town tho
in10RjFox · M
@DarianPaige wherever it be.. law is the same.
Cops plant drugs all the time. That is how they make sergeant.
DarianPaige · 26-30, F
@AtticEscapee cops are so corrupt 🤬
TexChik · F
@AtticEscapee prove that.
TexChik · F
@DarianPaige Not all
cherokeepatti · 61-69, F
Maybe he was trying to get her to confess and she didn’t go along with it
DarianPaige · 26-30, F
@cherokeepatti that’s what I was thinking.. thank you.
