Just a question I have regarding drugs and police officers just letting them go????

So someone very close to me dozed off at her job last night & of course they blamed it on drugs. This person DOES have a history with drugs, but apparently is sober now, I don’t really know. She had a meth charge in like 2018… This man at her work called the cops on her last night, cop interrogated her in the parking lot.. Cop eventually searched her car & her purse, said they found all kind of residue on her belongings and even did drug tests on all the residue he collected right there in the parking lot, said it came back positive for meth… but then… he said “I’m just gonna let you go on and leave, but I’m not letting you drive so call someone to come get you” (she called me).. and idk, I’m just wondering if he really found all this residue that came back positive, would he really have just let her go?! Or was he just sayin that it was positive for meth to scare her…
He kept her there for about 2 hours interrogating her, he was apparently off duty, wasn’t in uniform, but had a trainee with him. He kept saying she was gonna go to jail bc of all this residue that came back positive, but eventually just let her go??

He had no probable cause to search her vehicle or detain her and violated her 4th and 5th Amendment rights. She was not arrested or Mirandized, so anything she said would be considered inadmissible. He was off duty, and all police protocols require that he phone it in (since it was a nonviolent situation) and get active-duty officers on the scenes (since they have body cams) to investigate. She needs to hire an attorney and go after the police department and the off-duty officer. A blood test determines if she has been using. Residue means nothing other than it was there, and since the officer violated so many other protocols and constitutional rights, her attorney could allege that the officer planted the "residue" to detain her illegally.

@TexChik thank u so much! He was a chief of police tho…..& it was a very small town, very country and small town people!! I am scared since it’s such a small town they will back him up and try to destroy anything that could get them in trouble?? Cops are sometimes SO corrupt .. We are gonna try to sue definitely !

@DarianPaige ( I amended what I wrote earlier) In court, without evidence and proper police procedure, the judge would throw the case out. Her hiring an attorney would be her best option if she does not want it to happen again.

@DarianPaige She needs to get a drug screening blood test done ASAP. If she's clean, then it would be a big piece of evidence and the store manager would also have some exposure.

@DarianPaige It takes a blood screen to test for amphetamines. Urine will indicate Pot use

@TexChik the cops don’t need probable cause to search a vehicle if the owner agrees to it.

@Dom987654321 But did she? He only stopped her based on the suspicions of a store manager. He detained and questioned her for 2 hours. The woman was intimidated and the officer violated her rights. She has a case.

@Dom987654321 idk if permission was ever given to search the car. She just said he told her he had probable cause so she just stood by and let him do it bc she thought she had no choice

@DarianPaige like I thought. He let her go because he knew it was an illegal search. If any of this was caught on camera she might need to go to a lawyer. She may have a possible lawsuit. If he searched her body and it was caught on any camera she will probably have a very good lawsuit.

@Dom987654321 only the first 5 minutes were caught on camera … we do have the part where he says “I was in bed asleep with my wife when I got called to come here, this is my off day” etc.. idk if that’ll be important to a lawyer or not. I don’t think he searched her body, he just searched the front part of her car & her purse. Idk why she quit recording. & idk if the camera outside of the store works or not! I hope it does.

@DarianPaige it’s important to always record it so she can prove it happened. Without it he will just lie and deny it. But she should still go to a lawyer. She might have a case but probably not.
