Just a question I have regarding drugs and police officers just letting them go????

So someone very close to me dozed off at her job last night & of course they blamed it on drugs. This person DOES have a history with drugs, but apparently is sober now, I don’t really know. She had a meth charge in like 2018… This man at her work called the cops on her last night, cop interrogated her in the parking lot.. Cop eventually searched her car & her purse, said they found all kind of residue on her belongings and even did drug tests on all the residue he collected right there in the parking lot, said it came back positive for meth… but then… he said “I’m just gonna let you go on and leave, but I’m not letting you drive so call someone to come get you” (she called me).. and idk, I’m just wondering if he really found all this residue that came back positive, would he really have just let her go?! Or was he just sayin that it was positive for meth to scare her…
He kept her there for about 2 hours interrogating her, he was apparently off duty, wasn’t in uniform, but had a trainee with him. He kept saying she was gonna go to jail bc of all this residue that came back positive, but eventually just let her go??

It’s hard to say. It’s too big of a coincidence for her to have a history of doing meth and he lied and just happened to guess the right drug.
My guess is he probably did something wrong and knew it so thought it was in his best interest to let her go. Possibly an illegal search which in that case he can’t use the meth as evidence against her.
He was probably interrogated her for 2 hours trying to get her to admit fault so he could arrest her and she didn’t. He definitely was using intimidation.
Your friend might have been sober and the cop found an old meth pipe that she forgot about.
She needs to understand how her rights work.

@Dom987654321 thank you so much!!!! He asked her “if I look ya up will I find anything in the system about you?” And she said well I had a drug charge and was on probation, I just finished my probation this year.. & he asked what the drug charge was and she said meth. That’s when he asked if he could search her car and at first she said no, but eventually said yes & he found “residue” that he tested right there & said it came back for meth……
I did think the whole thing was illegal - he searched only the front part of her car, which was odd to me. She’s thinking he didn’t search the entire car bc he knew he was in the wrong and it was an illegal search.

Your friend needs to learn how her rights work. She was under no legal obligation to answer his questions. The only questions she is ever required to answer are identity questions like her name and address. And that is also dependent upon t to be state sue lives in. She can ask just show her id give her name and address and say I want to use my right to remain silent and the cop can’t do anything about it. Also she should have asked am I being detained? I want to leave but I can’t because you’re detaining me.
A lot of times cops aren’t legally detaining you and you are free to just leave but you don’t know that and they just let you think you have to stay.

@Dom987654321 She should have said I want to use my right to remain silent. She has a 5th amendment right to not testify against herself even to the police

@Dom987654321 thank you soo much you’ve been sooo helpful!!! That’s one of the first things he said to her.. before he went into the store to look at camera footage he said “you are being detained so do not leave. If you leave I will find you and arrest you” …… & he went into the store to look at camera footage. He also lied about this bc he said he saw her on camera dozing off, then a few minutes later said “I can’t even view the camera because the guy who has access to cameras is not at work tonight” ?? & then several minutes later again said he saw the dude yelling at her on camera … so like were u able to see the cameras or not? 😕 He said “in the morning I am coming back up to this store so look at the camera footage and if I see something I don’t like, I am coming to your house to arrest you” & he took pics of her ID. ….. it was so fucked up. I’m young, I’m only 25 & never been in anyyy trouble, I’m so confused & don’t understand her rights or mine for that matter. Thanks so much you’ve been so helpful !!!

@Dom987654321 idk if she ever really agreed to a search. I wasn’t there.. she said bc he found residue in a little case in her purse, that that was probable cause to be searched. By eventually said yes I meant she just gave in and let him search bc she thought she had to let him.. he said he had probable cause so he was going to do it.. like I said I wasn’t there. So I’m just repeating what I was told & what I heard myself from the short video footage she took

@DarianPaige it’s legal for the police to lie to you and they will. It’s illegal for you to lie to them.
Most people are ignorant of how their rights work and the police are great at taking advantage of your ignorance. There is no point in even having rights if you don’t know how they work.
I also believe we should legalize drugs like meth. Your friend is an adult and as long as she doesn’t drive or cause problems it’s nobody’s business what she puts into her body.

@DarianPaige idk if permission was ever given to search the car. She just said he told her he had probable cause so she just stood by and let him do it bc she thought she had no choice

@Dom987654321 didn’t give it back to her until the very end. I was already there to pick her up & he was taking pictures of her ID so that he can “come to her house to arrest her if he finds anything against her today” 🤣 He gave it back to her right before he left

@DarianPaige that would explain why he let her go. He was illegally detaining her. She needs to go file a complaint against him.
