They're in human stages at all times, but to me they become a person when they gain consciousness. (about 5 months).

I agree with the people talking about personhood, although I don't know when exactly that happens and whether we can really tell.
If I were you I'd also add "when the blastocyst gets implanted in the womb". Tbh idk why people never think of it when they want to define the beginning of life.

@JAYS21 True, but at any level, I don't see any animal as less than a human.
That might not make sense it terms of the question.
If it's merely what determines the species "human" - then any fragment containing human DNA code is human, whether a single gamete or a scrap of torn off skin.
If it's a whole human being - then I would still stand by my first answer - simply because they cannot breathe. It's the first most basic capacity for an independent life, the least possible necessity without which the parents cannot care for him or her.
