Nullifying SCOTUS itself perhaps

@val70 Nullifying SCOTUS itself perhaps
You might be dangerous had you ever read anything that didn't come in a coloring book.
The Supreme Court was NEVER intended to be able to overturn Congressional legislation or pass laws from the bench. There is NOTHING in the Constitution giving them that right.
The Supreme Court gave itself the right to legislate from the bench (they call it judicial review) in "Marbury V. Madison."
Find someone who has actually attended a real school to read that opinion and explain it to you.

@Reason10 Trust me, in these times even an European like myself doesn't look towards legal precedent nor history any more for what will happen next. So there, you try learning four languages and only a tiny bit of each culture that is represented in my own country. Keep your insults for yourself, please

It's procedurally impossible (IMPOSSIBLE) to nullify the overturn. Perhaps you mean restoring the rights that Roe v. Wade provided. If so, legislation by Congress and supported by the president would be able to do that.
AthrillatheHunt · 51-55, M
I’m still eating crow for saying it would never be overturned so IDK

@BlueGreenGrey appeasements are made all the time. Look at Hong Kong , East Germany , Donbas in UK, etc..just a part of doing business

Another precedent case

Having the majority of the supreme court not be right-wing would probably do it. But that means either packing the court which just becomes an arms race when parties switch power, or consistently having a non-republican in the president's seat when vacancies come up - but that would happen over decades

@Reason10 Abortion was legal and practiced at the time the Constitution was written (Ben Franklin even included a method in a 1748 book). Can you show us where in the Constitution it outlaws the formerly legal practice of abortion?
I eagerly await your answer!
Three days later ... STILL WAITING!!!

@jshm2 Effectively, Trump has poisoned the wells, so there is only a path to hell; regardless of who sits at the helm.
You uneducated goose steppers really HATE losing an argument.
The only people poisoning wells are left wingers. The left wing Justice Blackmum Supreme Court perpetrated a worse HOLOCAUST than Hitler.
Seig Heil.

Why would we want to be an activist court? Just have congress pass a bill.

Seems to me that Roe v Wade started that. The court COULD have said “abortion is not the governments business period”. That would have ended it.
At the time a lot of women didn’t like THAT decision. Had that SCOTUS ruled that “It’s none of the government’s business. The end.” then this would have been over and done with and women would have been way happier since then.
Justice Blackmun a liberal wrote the opinion approved by a liberal majority. How about that?
