Could I use a therapist statement about mental suffering in accident claim ..

If they were no longer my therapist?

I really need a new therapist ..someone who has extensive training in PTSD. I was in an accident and need a statement from them however to support my emotional damages claim. She seemed pretty hesitant to commit to making a statement for me a few months ago but I'm going to request one officially soon.

If she does provide support that I get anxious with people stopping behind me in a car abruptly, can I use it , regardless if I switch therapist? My claim may not go forward for another month or so because I'll be in a few more weeks treatment. But I'm not sure I can stay with her that much longer. I need true healing techniques.
Is it a possibility I can have her claim, if she writes it, even if I begin with a different therapist during the claim?

Switching therapist when one definitely has still the need for one is wise. Personally, I found my first therapist not taking my trauma seriously enough. The second took it very differently. She was also a spiritual director at a Baptist church. When I would say that someone duing a job interview claimed that I was overthinking she put it forward as an issue to take in regard and not to dimiss nor cure. Everything about me is me but I need to overcome so much. Even the dyslexia and a stutter

Short answer is yes.

Psychiatric therapy notes are admissable in court as proof of harm or injury - the same as other medical records.

But before pursuing a claim in court I suggest you consult with a qualified attorney, if you haven't already.

I think any qualified psychiatrist can help. You need a person who can prescribe so you can have evidence of ongoing disability.

@Muthafukajones I'm with a therapist not psychiatrist..this is for emotional damage from car accident ...not my regular PTSD ( which is a disability in itself). You may have been thinking of disability claim ?

@Coralmist Yes for a claim for benefits a psychiatrist might be a better choice.

You should be able to use a statement from any therapist; past or present. More recent\current is helpful but to document it already being a thing is helpful. History of a persistent condition is crucial.

@jehova So even if I wasn't under her care when I put in a claim, as long as it was recently I can use her statement?

@Coralmist yes that should be admissable. Also to establish it already being diagnosed and documentex will be useful.

@Musicman Thank you. Now I just hope they agree to helping support me. They seemed hesitant to provide it a couple months ago and changed the subject. But I'm going to explain it doesn't have to prove PTSD, just to show my life did change after the accident, during driving, becoming very hypervgilant when someone stops behind me.

@Musicman I'm wondering to ask for it now, Even though I'm not doing claim for a few more weeks. Or to wait until that time. But by then I hope to be with another therapist. So as long as I can go back as a non client to ask for it??
