Are we blinding ourselves with thinking about human rights when the victims of crime never had theirs respected?

If you do something outside of the law why does the law first need to ensure your rights are protected? Surely by going outside of the laws you show no concern for the law and you become an outlaw and must be treated that way, otherwise every person killed in war is also protected by law and the victors need to be prosecuted for their disrespect for the law??
Explain the concepts…..

This does sort of touch on my ideas of "justice" as opposed to the law.. Basically a person who has been shown to violate the rights of another and caused them harm or damage should not be provided protection under the law..
There was an old concept in some old world countries of the "outlaw". An offender was marked or branded in a visible manner (Yes. Pretty barbaric, but work with me a moment). And anyone could treat that person badly, even illegally, without fear of prosecution..
Now I wouldnt go so far.. However, I do feel that the current system certainly pays way too much attention to the rights of the criminal. Not balancing the harm done to the victim... There is something to be said for an eye for an eye, even as a deterrent..😷
