You can sue for anything, anytime, anywhere...
If you can win anything is a completely different story... first question, is it bad? If no... then maybe you can let it go or fix it yourself.
If it's really bad... then I would file a complaint ASAP and get it in writing and pictures of some sort.
Maybe even call the police to do a report... NOTE: DO NOT CALL 911, it's not an emergency, but the police have non-emergency numbers as well you can look up and call.
