Marriage is a governmental function that is handled by a subcontractor, the church.

That's not legal under the US constitution.
The involvement of government is compulsory if you don't want to admit government involvement and no contract made involuntarily is valid in any court of law.
Married couples of religious faith have the right to be married for the religious reasons practiced by their ancestors without asshats claiming that because the government is too powerful to oppose that government has the authority to negate God's laws.
Now since you seem to think that Government is your God and God is nothing to you I expect you won't understand that the union of two souls is Gods business, not yours, mine or any given group's.
