There’s not a word about abortion in the constitution. Gun rights make up 10% of the Bill of Rights. State laws cannot violate the constitution. The Texas law does not. The proposed California law does.

@redredred I am not the person who should be defining assault weapons for the purpose of regulation. I've told you what arms I believe should not be allowable, as they are not needed to be used for protection nor hunting. We would have far fewer deaths today if we had banned these weapons in 1968 or in the 1990s, or any time up to the present.

There is a fundamental difference between arms specifically designed to kill large numbers of people and other commodities that have beneficial uses. It is disingenuous to assume an equivalency.

@windinhishair Your first sentence is the only one here that makes sense. The second amendment has nothing to do with hunting. It is all about enabling the killing of faithless politicians and their hangers on.

Personal weapons comparable to what government forces have seems to be a good measure to me for that purpose.

@redredred Government forces have heavy artillery, machine guns, heat-seeking missiles, etc. Your proposal to allow private citizens to own the same weapons is preposterous. It is people like you that have made the US into a gun-crazed fetish state, to our great detriment, and have caused many deaths.

But back to your original post. There is nothing in the Constitution that prevents California from enacting gun laws along the lines of the Texas abortion law, should that law be upheld. Or allowing the bill recently introduced into the Pennsylvania legislature to become law. That bill mandates all men to have a vasectomy after causing three pregnancies or when a man turns 40, whichever is first.

@windinhishair Nor I, but I have read a little about it. Robert Axelrod set up a competition to find the best strategy in actors expressed as populations of small computer programs. Tit for Tat by Anatol Rapoport won the early iterated competition and similar strategies also were successful against more sophisticated challengers later.

Unfortunately the Republicans have their own "interpretation" of the constitution.

They have made the constitution a "religious" document. And why they interpret the constitution differently than other political parties.

And I do mean All other political parties! Not just Democrats.

Change the constitution! Not the state laws that the supreme court can overrule!

This is not just a gun or abortion issue! These are constitutional issues that are badly in need of change! So they can't change it!

@Northwest Exactly. The extremism of the current Court makeup to accept such a state law would effectively reduce the Court's future impact, if states could simply run around rulings they dislike.

The main issue is that just as drug laws do nothing to prevent people from getting drugs and prohibition did nothing to prevent people from getting beer, wine, and liquor, gun laws do nothing to prevent people from getting guns. In Economics 101, you should have learned that in the absence of legal markets, illegal black markets will always provide supply to meet demand. So gun control laws sound good, but they won't curb gun violence.

@RedBaron Because they will result in fewer guns in the marketplace, and fewer guns leads to fewer gun deaths. I agree with you that someone intent in obtaining a weapon of mass killing can obtain one illegally, but not everyone will do so. I think we probably agree on this issue more than we disagree. Where we disagree is that I believe the (at least initially) marginal improvement is a start and worthwhile, whereas you see it as completely ineffective. I get it, but we have to start somewhere, and I believe we would see modest changes that increase over time.
@windinhishair bullshit criminals don't buy guns in retail settings or complete background checks. Why do you think the crime and looting all over the TV isn't happening in red states?

@ElwoodBlues The current Court used foreign law in the questioning of lawyers in the recent Mississippi abortion case, although they have rejected foreign law previously. This Court seems bent on twisting existing law to finally outlaw abortion, no matter how much damage is done to the Court or our legal system.
