@sunsporter1649 All sources agree Pretti had a valid concealed carry permit. Whether the permit was on his person has no criminal consequence.
State law says not carrying a permit is a “petty misdemeanor” subject to a fine of up to $25. Such a violation “does not constitute a crime,” state law says.
But let's drill down on the physical location of Alex Pretti's permit. Here's the gray coated agent carrying Pretti's gun away from the site of the killing. It's interesting that gray coat isn't wearing ANY sort of ICE insignia, but that's a question for another day.
Grey coat did not bag and tag the evidence at the scene. Instead, gray coat carried it to a truck, laid it on the seat, and took some photos he later posted to social media. Failing to bag and tag at the scene violates police protocol because it breaks the chain of custody, which could have major ramifications in court.
For example, suppose Pretti's associates later swore in court that he always kept his permit attached to the two clips that were attached to his SIG Sauer P320. That would raise a valid question about whether the evidence was tampered with when it was carried away to a truck and photographed. Perhaps the permit had been with the gun and was removed.
Breaking the chain of custody leaves law enforcement vulnerable in court to these kinds of questions. Cops know this and are well trained in evidence handling procedures; ICE screwed up.
And given that ICE lied when they claimed Pretti "drew his gun" and lied when they said he "brandished" it, one could raise a valid question in court as to whether gray coat committed further falsity by removing the permit and tampering with evidence when he took the gun and broke the chain of custody.
I know that's way too much for you to read at one time sunstroke, but tough luck. I'm not gonna spoon feed it to you in tiny nibbles.
