Oh, no, that's not how this works. See, the ruling means that the SCOTUS will decide whether or not a crime was an "official act." And the Republicans control the SCOTUS, so if Biden broke laws like Trump, they'll just say those crimes don't count as official acts. Basically, this is a blank check but only for Republicans.

@BohemianBabe I thought SCOTUS said it was up to the lower courts to make those decisions, which is why Judge Chutkan now has to sort through the J6 case to see what was an official act and what wasn’t.

@BohemianBabe True, but wouldn’t it’s still have to work its way up the appeals process first? SCOTUS doesn’t typically hear a case that hasn’t been appealed yet…at least I think that’s how it works.
I think Beau’s take on YouTube is probably pretty accurate…that this will ping pong up and down the courts for several years until we finally have a more clear definition of official acts and non official acts.

@Zaphod42 Yeah, but what that amounts to is a blank check for Republican presidents. Either it ping pongs for literally decades, and a decision is never made, or it ends up at the SCOTUS and they just declare the crime an "official act."
This is usually how authoritarianism works. The law is always very unclear, so the people in charge can interpret it however they want. Ron DeSantis' "Don't Say Gay" bill never actually say teachers couldn't say "gay." But it was phrased in a way that would essentially only harm queer people.
