Oral Argument on the Constitutionality of the Special Counsel Jack Smith
On June 21, Judge Cannon will hold oral argument on the Appointments Clause challenge to Special Counsel Jack Smith's prosecution of Donald Trump. The Court granted leave for three amici to argue.
The parties will argue on President Trump’s motion to dismiss the indictment based on the unlawful appointment of the special counsel. As the judge previously indicated, amici including experts who advanced this legal theory will be allowed to participate in the hearing.
The judge’s announcement of the hearing some weeks ago coincided with her decision to indefinitely postpone the classified documents case against the former president.
