I don't care about the rules...but they still apply to me

“While President Biden refuses to do his job and enforce the immigration laws enacted by Congress, the State of Texas is once again stepping up and taking unprecedented action to protect Americans and secure our southern border.” Tough words from TX Gov. Abbott and his order that any law enforcement official may return migrants to the border without due process.

Too bad he's in violation of federal law and won't get his childish "look at me" way.

The American Immigration Council (AIC) responded to Abbott’s order on Thursday, arguing that it ignored a previous Supreme Court ruling that states cannot carry out immigration enforcement.

“Authorizing state law enforcement to deport migrants could expose law enforcement agents to significant legal risk,” the council wrote in a statement, citing a separate executive order by Abbott that was struck down by a judge last year.
AIC Policy Director Aaron Reichlin-Melnick added: “Federal law is clear: states may not carry out immigration enforcement on their own and migrants have a right to request asylum and to be processed under our immigration laws.”

Sanctuary cities ignore Federal law in order to protect illegal immigrants all of the time.I have no issue with a state power that wants to go the other way.

@DavidT8899 Local law enforcement is tasked to deal with criminal activity, not documentation of its citizenry. Making them an extension of ICE turns them and us into a fascistic police state, undermining their authority and support in our communities and the courts have repeatedly ruled it also is un-Constitutional.

Here’s where we get to important legal point #1: being undocumented is not a crime. It’s a civil violation. Undocumented immigrants have rights under the U.S. Constitution. And according to due process, the police cannot detain anyone who hasn’t at least been suspected of a crime. If a police officer encounters someone walking down the street who turns out to be undocumented, they cannot arrest that person because that person has not committed a crime (ICE, however, can). Similarly, if the police arrest someone undocumented – for example, someone suspected of committing a crime, who is then cleared, they must let that person go.

Important legal point #2: holding an immigrant past the point when they should be released, just so that ICE can pick them up, is unconstitutional. Multiple courts have said so, and immigrants can sue the police for unlawful holding.

Here we get back to the point of sanctuary cities: in a sanctuary city, the police will release an arrested immigrant after he’s been cleared of charges, posted bail, or completed jail time for whatever he was arrested for. A non-sanctuary city will hold that person until ICE can come pick them up – even though that extra holding is not constitutional.

Keep in mind that all of the above only applies if the undocumented person has not committed any serious crimes. If they have, the police can keep them in jail by filing charges. Or ICE can present the police with a warrant or other order from a judge, which will result in a hold until ICE can come by.

@Graylight Not like you seem to have.You dont seem to have a great deal of rhis compassion for the American citizens,do you?(Does the term,"angel mom"ring a bell?)And dispite the dishonest ramblings of dancingtouge,the FACT is that sanctuary cities refuse to hold-and many times even release-illegal aliens who have been charged with felonies,many of whom go out to commit more crimes.Exactly how legal-or compassionate-is that?

We are a sanctuary city, and it doesn't work anywhere near that.
