I don't agree with the "sexual" harassment charges (since been dropped by the way.) But we also don't know what happened so we can't make an opinion. We don't know their previous relationship and we don't know what was said leading up to the events.
I will say this, the kid said in a recent Daily Mail article that he can say whatever he wants because it's his 1st amendment right. The person who they misgendered could have gone full psycho on them sure... but most normal people don't say "it's my free speech" if there was nothing wrong said. It implies guilt, it doesn't mean they did anything but it is implied.
If I was in that situation and I was truly innocent I would say something like "they didn't tell me what they preferred and they just went psycho on me for no reason, I don't understand what I did wrong." What I wouldn't do is say "it's my right to call you whatever I want and I can do whatever I want to you."

@SatanBurger Most kids don't know the 1st Amendment from a hole in the ground, they had to learn that from their parents or something similar, attitudes like this are learned behaviour and someone is teaching them wrong... 😖

@spjennifer Yeah the mom is def. using her son to get on Fox News. The first amendment isn't something kids would just say, they're more interested in cartoons and playing outside.

@SatanBurger This is a "young teenager" and like you say most of them are a lot more into music and video games than the Constitution, sounds to me like he's getting his attitude from his Mother. I don't necessarily agree that it's "Sexual harassment" to misgender another student intentionally but it certainly fits with bullying which is prohibited too. We have to live with much of the same things as adults with HR Policies so kids had better get used to it too...

@spjennifer Well to use the constitution as an excuse looks like the kid's been coached by his mother. The thing that I wonder about is the kid's past behavior towards this nonbinary individual. It's one thing if he didn't know and the nonbinary person flipped out on them, I'll give them that. I would be outraged if someone said I did this intentionally if I did not. But it is kind of suspect how the whole thing played out, if he knew them as a fellow classmate, people can't tell me that there was no other interaction before that.
I know the news is trying to protect people because they're children so they can't release statements but it hurts more than helps to not be transparent because people use this as a political ploy.

@SatanBurger seems like the person switched their identity roughly a month or so before (if that's true) the incident. It definitely seems like more is missing though.
@spjennifer idk, I was a wise ass teenager and knew the 1st, 2nd, and 5th amendment pretty well by middle school (literally would tell my mom off with it lol.

@Turtlepower Yeah I mean I think it's far from sexual harassment, I don't know where the school got that unless there was actual sexual harassment involved, that's a lawsuit personally. On the other hand, when the kid used "it's my free speech" has me thinking something more occurred. I can't explain what's wrong with this statement but it sounds off putting.
Oh... it's kind of like using the bible. I heard a forensic psychologist explain that during interrogations when the suspect praises on the bible and brings up God, they're always lying. I can't say if someone is lying out in every day life if they said that, they could legit think that it makes them look innocent but in an prison setting where you're being questioned, it's suspect.
Like swearing on free speech, sounds kind of off. Out of all the emotional reactions you could do and you say "my free speech though," sounds cold and off.

@Turtlepower Oh... I guess it sounds off because the kid isn't denying that "something" was said with pleading about free speech. Out of all the things that could be said and one says "my free speech though." Only people who plan on saying something they know bothers the other person says that.
