U.S. Supreme Court takes aim at separation of church and state

The conservative-majority U.S. Supreme Court has chipped away at the wall separating church and state in a series of new rulings, eroding American legal traditions intended to prevent government officials from promoting any particular faith.

In three decisions in the past eight weeks, the court has ruled against government officials whose policies and actions were taken to avoid violating the U.S. Constitution's First Amendment prohibition on governmental endorsement of religion - known as the "establishment clause."

They also delivered a decision on Friday that was hailed by religious conservatives - overturning the 1973 Roe v. Wade ruling that legalized abortion nationwide - though that case did not involve the establishment clause.

Don't lose focus - it's not any particular group they're going after, it's everyone.

In Thomas' opinion, he specifically called out gay marriage, gay sex, & contraception as rights to be reviewed. In other words, the dude wants to get rid of gay rights and straight rights... nice. The Court also said you can't sue the cops for failing to read the Miranda warnings, which means you don't have a right to them in any meaningful way. You also can't sue Border Patrol for unlawful search and seizure in a huge swath of the country.

But don't be fooled, the Supreme Court can 100% be stopped. First of all, we can just add more justices once we get a non-manchin majority in the Senate. Second of all, we could impeach Clarence Thomas for conflict of interest if we can somehow drum up the votes for that (which is admittedly very far-fetched). But perhaps most importantly, the Supreme Court doesn't command a police force. If they lose legitimacy, we can just ignore their rulings and keep going about our business. Wouldn't be the first time.

@Graylight Just to be clear. I am not in the 4th grade however if to add it all up I probably am in 23rd counting grad and post doc years.

@Panda5689 Then I'd guess you also understand no one implied you stopped education at the 4th grade (that was directed to another use) and that this is posted in the wrong place.

No it can't be stopped, the easiest way to deal with the decision which has recently got some people upset is the pass a law which federalizes the right to abortion. The house proposed legislation which would protect personal data stored on reproductive health apps, ensure the right to free travel between states and codify the right to an abortion. Also to codify abortion rights as set out under the 1973 Roe decision in a bill known as the Women’s Health Protection Act. Of course blocked by a senate filibuster. We have not always had the filibuster and the Democrats in the senate could get rid of it with the stroke of the pen while they are still in power. Would have other consequences but they are going to get pressured to do it.
@Subsumedpat yes it can, but relying on the federal government to do anything is foolish. It took 100 years after the civil war to stand up for civil rights.

@checkoutanytime This is real simple, you do both. That is what I am going to do, vote against the anti-choice candidates at the state and federal level. The November elections will send a very strong message one way or the other.
@Subsumedpat i dont think anyone would vote for those vampires. They are the ones taking the waste and profitting off it.
Based on their statements on other cases that they plan to "review" it seems anyone who is not straight is going to be their next victims.

I hope Thomas dies very soon, I also think, even though he’s politically opposed to my beliefs, he is “not of sound mind and body”. Also I’ve never understood the Supreme Court to be an attack force entity that pulls up things to decide on. I thought they responded to cases brought about by others and could hear or reject them by their choice. This points out they are GOP legislators in their activities, not a court.

@checkoutanytime All knowledge is knowledge and leads to increased information. It's asinine to say otherwise.

What I'm referring to is that learning is more than knowing which box to check or memorizing dates. It's learning how to educate yourself, because there are methods that guard against misinformation and faulty conclusions. There are practices to test theories, debate, examine. It's developing an appreciation for all areas of life and understanding the interplay between them. And yes, it's specialized education and training; that's how we get doctors, attorneys, etc. Further, education isn't a class issue; knowledge is free to the world, our little corner of it more so than anywhere else. To dismiss it for personal hunches indicates an ignorance that belies any hope of expanding one's horizons.

In a general sense, "You don't know what you don't know." Without ever searching for what's over the next hill, you end up living in a hole. And let me be clear - for all the wrasslin' you and I do, I respect your education and can easily intuit your natural intelligence. I'm only suggesting that it should be used as a base on which to grow, not the antenna from the top of the building.
@Graylight hence my conservative perspective vs your liberal perspective. In my review of History the greatest thinkers were self taught, or aprenticed. Which agrees with you to the point of teaching ones self how to expand. I dont find people that present themselves as superior bc they are educated to be rational thinkers or open minded, is my perspective. Yes, i do respect you and everyones opinion, i do play around bc i like to stick up for people that people may inovertanly be insulting by their narrow perspective.

There are ways the Court can be brought to heel. It's not untouchable. The current powers that be just wont do it. Good fundraising material.

It should be ignored. I no longer recognize Marbury v. Madison. It’s time to stop these fuckers by declaring the Court illegitimate as it’s current configuration was based on lies, nullification of advise and consent, and represents only a minority of the people.

@Fukfacewillie I can only assume since it's the season on "reviewing other, older cases," that none of them should be considered as legally mandatory to follow. F**k the rules - if it's all about politics, I'll start my Party of One.

@Graylight A nationwide bad would require a complete breakdown of prior judicial tradition of the Supreme Court and federal supremacy if Congress passes such a law.
