The Cornell 7 Case...please stop spreading misinformation and ruining people's lives

Saw this story all over the left wing media. I see some leftists on here writing screeds about how society has failed us, or women worrying about rape and assault.

Here are some FACTS about this case that you are free to confirm on your own:

Regarding "Jane Doe's" experience: It was ENTIRELY consensual. She consumed alcohol, and ketamine of her own free will. She chose to engage in sex with multiple partners and later, expressed her desire to do it again.

She spoke to the police and prosecutors: They chose not to do anything with the story...because no crime was committed. Under New York law, if you knowingly consume intoxicants willingly, you cannot use that as an excuse to say you were raped...in other words, if you consent to consuming alcohol and drugs, you consent to not using that as an excuse for a bad decision.

Left wing activists and social media trolls have taken to exposing the 7 men involved in the situation. They have doxxed them, identified them, gotten some of them fired, and have threatened them with more.

Mind you...not one of these individuals have been charged with a crime, let alone been convicted of one.

Somehow though, activists have decided these individuals need to be punished and are doing all they can to ruin their lives.... not to seek justice or to look into it so we can make things better...no, it's totally retribution and punishment doled out by sinister online forces who are not held accountable for their actions.

I implore you to do your own research...stop listening to hearsay and shitty pundits who are just looking to get their name out there and use this as an opportunity to gain followers and attention.

@4meAndyou Not necessarily. If the person is incapacitated due to ketamine, then yes.

It doesn't apply in this situation as we know it, as she was conscious and able to give consent to the sexual activity she engaged in.

Ketamine, Consent, and New York Law
Under New York law, being under the influence of ketamine does not automatically make a person legally incapable of consent, but if the person is physically helpless due to intoxication, they cannot legally consent to sexual activity .

Current law on consent and intoxication
New York’s sexual assault statutes do not have a blanket “voluntary intoxication” exemption. The law recognizes that voluntary consumption of alcohol or drugs does not itself make a person consent to sexual acts

. However, if the intoxication (from ketamine or otherwise) renders the person physically helpless — meaning they cannot understand the nature of the act or resist it — then they are legally unable to consent

. This is consistent with the “physical helplessness” standard used in many jurisdictions.

In the Cornell case, legal experts have stated that ketamine use does not equal consent; if the victim was incapacitated to the point of being unable to comprehend or refuse the act, the law treats that as non‑consent

Where is it said that she consented? I'm looking for a source for that but can't find it. I know that one of the accused has said it but that isn't a reliable source, obviously. Did she admit consent?

@SumKindaMunster Whoah, don't jump the gun. I'm just listening and learning. On revisiting the clip he was talking about the 2026 lawsuit rather than the original allegations. In this latest lawsuit she talks of consenting to up to 3 males, allegedly. I don't have a position on this other than understanding what is likely true. I hate rapists but I equally hate false accusers of rape.

I'm just waiting for some woman to get drunk and drive home, kill somebody, and then have her car charged with kidnapping, because she was too intoxicated to consent to drive.

I think the element that pushed it over the top for many people was the guys texting "free pussy" to their friends. Did she agree to that too? But you're right, it's an ambiguous case and given the legal hurdles, I can see why the DA didn't prosecute. And the way the boys have been tried and convicted in the media is unfortunate. But anything like this is going to become another polarized left-right issue.

My understanding is that the encounters were entirely consensual.

This is the original reporting on the story. The only way this is consensual is if she was lying. And this is a hell of a lie to stake your life on because the consequences for her are extreme and life-altering, anonymous or not.

This is a Civil lawsuit, and the determination of "truth" is held to the "preponderance of the evidence", aka, if the evidence shows that it is likely to have happened at 51% or above, then the plaintiff wins the case.

The only way this is consensual is if she was lying. And this is a hell of a lie to stake your life on because the consequences for her are extreme and life-altering, anonymous or not.

Hmm, was the lady who accused the Duke lacrosse team of rape life ruined due to her fake allegations?
How about Kesha's phony accusations of sexual assault by Dr Luke? After she had to walk that back, did it impact her career negatively?
How about Virginia Giuffre accusations of being raped by Alan Dershowitz? That got dismissed as nonsense, but it didn't seemingly affect her credibility on some of the other accusations she made.

Ask yourself what consequences this woman will receive should her suit be dismissed without merit? I feel confident is saying she will be defended and protected no matter what the outcome.

@SumKindaMunster They do not directly contradict. They are inconsistent. This is almost always the case in sexual assault claims because of the impact of trauma on the memory. In both statements she is very clear that she was raped.

The legal standards to prove a criminal or civil claim are not interesting or compelling to me on sexual assault. The justice system is very bad at this issue. These crimes are almost always committed without physical evidence or third party witnesses. Just "he said she said" and 'she' in this case is traumatized and unable to give consistent testimony.

Police do not investigate 4/5 of rape cases brought to them in the US. Similar stats in Canada. Of those which are investigated, almost none of them result in convictions. By that purely "you have to prove it for it to be real" lens, rape does not meaningfully exist as a social problem and we owe Jimmy Saville an apology.

I don't think its so clear she was raped. She consented multiple times and went along with the activities that others were engaging in, including consuming drugs and alcohol, and consenting to multiple sexual encounters.

Well, that's your personal preference, then. The rest of us like to run these things through the Criminal Justice system since that sets a clear standard as to what needs to happen to prove a crime was committed and to punish the perpetrator(s).

I don't agree. People lie, and women are people too. It IS many times a "he said, she said" scenario and that unfortunately, is a consequence of this specific situation. Two people (or more) can experience something similar, but how they choose to interpret and process that situation can be different. I don't think we "believe all women" just like we don't assume the man's perspective is the ultimate truth either.

You are an idealist. And if we had 8 billion Canadian Dave idealists in the world, perhaps we wouldn't have this problem. The world might be a better place. But sadly, we don't.

I am a pragmatist. I deal with things as they are, not how I wish they would be.

I am, actually. I think its appropriate that the person who would actually be responsible for proving the rape declined to prosecute knowing it was not so clear cut.

But hey, who cares right? The online mob will get justice. Getting those guys fired, cancelled and ruining their lives is a totally appropriate response and we should thank the online vigilantes for doing that.
