Are we losing the balance of power in America?

Are we in the last days of self rule? Has the 3 separate but equal branches of government been discarded? Immigrants, both legal and illegal come here and suddenly use our laws and constitution against us and a judge rules in their favor. A serious question, has the US government become a dictatorship? No, it isn’t Trump the dictator, the judiciary has usurped powers not granted to them. Congress sits on its hands and so shirks its duties that a single judge decides. Who granted the judiciary that power, it certainly isn’t in our constitution, is it? I thought the second election of Trump would end the discrimination by the democrats, instead it seems to have gotten worse. Much worse!
A state governor and city mayors defy the federal government’s given powers and nothing happens. Anarchy reigns with what appears no way of impeding. Insurrection is rampant and there seems no control is granted. “a toothless tiger” this isn’t a joke folks, this is a rebellion pure and simple. How do we clean out the rats nest called the media, How do we reverse the tide of those that destroy freedom every day, and in every way? It appears both the FBI and the Department of Justice are dragging their feet, watching this nation sinking into a morass of turbulence unthinkable a few short decades ago.
Then we have a band of immigrants, from a African nation so backward it can’t do anything but be pirates come here, setup a sophisticated theft ring that steals billions without anyone raising the alarmist it then has the audacity to claim racism and that results in no headlines, except from a single non-professional reporter. Are we so inundated with the brainwashed it’s impossible to rectify the chaos created? Diversions are an everyday happening, those opposite this chaos creating band of insurrection yet our media fails us once again. Is the answer capitulation? A surrender where we accept a one party rule such as California or Minnesota? The slow creep of communism is forcing us to stay stoic? is this nation heading for the ash heap of history, has our education system so warped the minds of the masses that surrender its the only answer? If we do nothing that will be! The real villain the media, it supplies garbage not reality. Are we on the verge of a civil war, judging from Minneapolis, perhaps

An asylum seeker is by legal definition never illegal, irrespective of the means by which they entered a country. If the Executive disagrees with this, they must go through the hard graft of unravelling 70 years of international law. They cannot simply make up law on the hoof. It is the job of the Judiciary to uphold the rule of law and resist Executive over-reach.

@SunshineGirl immigration proceedings to barring aliens entry are to remove or deport. That is, deport and remove are synonymous in federal immigration law. An alien present inside the United States are not criminal proceedings. As the Supreme Court first outlined in 1893 in Fung you ting versus us a decision in which it rejected habeas corpus petitions filed by Chinese citizens who claimed they were being unlawfully detained by U.S. Marshals, quote, without due process of law, unquote.

The immigration proceeding is in no proper sense a trial and sentence for a crime or offense. It is simply the ascertainment by appropriate and lawful means of the fact, whether the conditions exist upon which Congress has enacted, that an alien of this particular class may remain within the country. The order of deportation is not a punishment for crime. It is but a method of enforcing the return to his own country of an alien who has not complied with the conditions upon the performance of which the government of the nation, acting within its constitutional authority and through the proper departments, has determined that his continuing to reside here shall depend.

Losing? Like present tense? Nah, we've lost it a long time ago. We're just seeing the effects of it now. Yes we are on the verge of a civil war, if not already happening to a small degree

Truth, good post.
The problem is that Congress has completely abdicated its responsibilities. The separation of powers only works when Congress and the White House are controlled by different parties. For whatever reason, fear of Trump endorsing a primary opponent or fear of their own constituents, Republicans in Congress seem incapable of or unwilling to rein in the blatant corruption and illegality of the administration.

This leaves judges as the only remaining protection for the rule of law, usually only lower courts as the Supreme Court is mostly a rubber stamp for the administration.
