Do you think that vaccine passports for all in the USA is a violation of HIPAA ? Guess again. You have no right to privacy, apparently.

Tell me, after reading this, if you disagree.

That's the Health Insurance Portability and Accountability Act of 1996.

HIPAA Privacy Rule
The Privacy Rule standards address the use and disclosure of individuals’ health information (known as “protected health information”) by entities subject to the Privacy Rule. These individuals and organizations are called “covered entities.” The Privacy Rule also contains standards for individuals’ rights to understand and control how their health information is used. A major goal of the Privacy Rule is to ensure that individuals’ health information is properly protected while allowing the flow of health information needed to provide and promote high quality health care and to protect the public’s health and well-being. The Privacy Rule strikes a balance that permits important uses of information while protecting the privacy of people who seek care and healing.

The following types of individuals and organizations are subject to the Privacy Rule and considered covered entities:

[b]Healthcare providers[/b]: Every healthcare provider, regardless of size of practice, who electronically transmits health information in connection with certain transactions. These transactions include claims, benefit eligibility inquiries, referral authorization requests, and other transactions for which HHS has established standards under the HIPAA Transactions Rule.
[b]Health plans[/b]: Entities that provide or pay the cost of medical care. Health plans include health, dental, vision, and prescription drug insurers; health maintenance organizations (HMOs); Medicare, Medicaid, Medicare+Choice, and Medicare supplement insurers; and long-term care insurers (excluding nursing home fixed-indemnity policies). Health plans also include employer-sponsored group health plans, government- and church-sponsored health plans, and multi-employer health plans.
[b]Exception[/b]: A group health plan with fewer than 50 participants that is administered solely by the employer that established and maintains the plan is not a covered entity.
Healthcare clearinghouses: Entities that process nonstandard information they receive from another entity into a standard (i.e., standard format or data content), or vice versa. In most instances, healthcare clearinghouses will receive individually identifiable health information only when they are providing these processing services to a health plan or healthcare provider as a business associate.
[b]Business associates[/b]: A person or organization (other than a member of a covered entity’s workforce) using or disclosing individually identifiable health information to perform or provide functions, activities, or services for a covered entity. These functions, activities, or services include claims processing, data analysis, utilization review, and billing.

Permitted Uses and Disclosures
A covered entity is permitted, but not required, to use and disclose protected health information, without an individual’s authorization, for the following purposes or situations:

Disclosure to the individual (if the information is required for access or accounting of disclosures, the entity MUST disclose to the individual)
Treatment, payment, and healthcare operations
Opportunity to agree or object to the disclosure of PHI (Informal permission may be obtained by asking the individual outright, or by circumstances that clearly give the individual the opportunity to agree, acquiesce, or object)
Incident to an otherwise permitted use and disclosure
[b]Public interest and benefit activities—The Privacy Rule permits use and disclosure of protected health information, without an individual’s authorization or permission, for 12 national priority purposes external icon:
1. When required by law
2. Public health activities
3. Victims of abuse or neglect or domestic violence
4. Health oversight activities
5. Judicial and administrative proceedings
6. Law enforcement
7. Functions (such as identification) concerning deceased persons
Cadaveric organ, eye, or tissue donation
8. Research, under certain conditions
9. To prevent or lessen a serious threat to health or safety
10. Essential government functions
11. Workers compensation
12. Limited dataset for research, public health, or healthcare operations

@Miklee02 In the UK, they do not have medical freedom. I am thinking of those parents whose child was basically kept a prisoner of the NHS so that he could die, while the parents were desperate to take their child to an innovative specialist in Italy.

@soar2newhighs There are ramifications to the so-called vaccine passport as well. The federal government plans to outsource the production of said passports to the private sector...to some big tech corporation....who will then be able to track your movements, and use them for marketing purposes.

Further, private corporations now have no legal impediment to sharing your information with their satellite offices overseas.
@4meAndyou I don’t trust these vaccines. Came out way too quickly as far as I’m concerned. I have no intention of getting vaccinated. Let’s see where we stand July 4th as per Joe. I’d go from there.

@questionWeaver They are planning to outsource the passports to big tech. So our private and personal health information will be sent, without our permission, to some huge corporation in the private sector.

"Should private entities develop a vaccine ID system, it will be crucial to ensure that access to credentials is equitable and accessible, no matter what technology limitations a person faces at home, said Slavitt and White House press secretary Jen Psaki, adding that it should also be private and secure. Psaki said the Biden administration is mostly focused on creating guidelines that can be used as a basis for private sector endeavors.

"We expect, as Andy Slavitt I think alluded to, that a determination or development of a vaccine passport or whatever you want to call it will be driven by the private sector," Psaki said. "Ours will more be focused on guidelines that can be used as a basis. If all it says is you've been vaccinated and certain places want to see it so you dont have to wear a mask or whatever I have no problem with it, if its mandatory I do. It's a slippery slope.

I can't believe people complain about violations when this pandemic has killed so many people and forced so many to live like prisoners for a year.
It's a pandemic, drastic measures have to be taken. Would you rather live the rest of your life in lockdown?

@DontLikeMondays I have been vaccinated. My objection is to the violation of privacy involved when passing our medical records around whether we like it or not.
HIPPA has too many loopholes. America went wrong when we started turning to government to solve our problems. Now they just do as they please

You already need a vaccine passport for yellow fever etc when travelling, what's different about this?

@Longpatrol This virus is only fatal to the elderly and to people with preexisting conditions, and not always fatal then. It is mutating to a new less lethal version of itself as we speak. And there are already indications in datasets in states that have been opened up, that herd immunity has begun. 30% of the population has been vaccinated. My son caught it, with two pre-existing conditions, says it is like a bad case of the flu, and he did not die of it.

I believe that these so-called vaccine passports should be reserved entirely for people who WANT to travel by air or ship, and the federal government should leave the rest of us the hell alone.
