Freedom of speech
Even hate speech is protected, but why anyone would want to make hate speech is beyond me.

Absolutely not; burning flags is a form of speech, and is therefore protected under law. The only corner-case exceptions are situations where it's either not your flag or it's being burned in a dangerous context (where it can hurt people/property).

What is a Pride Flag? Should burning a Red Sox flag be seen as a hate crime? I would imagine in the Bronx it may be viewed as good taste.

@GallantlyChurlish You're trolling but I'll bite just to state the obvious. A hate crime is when you target someone for specifically being something you are against. Like killing LGBT people because you don't like them is a hate crime and we very much have those, since Matthew Shepard and way before.

It's a good question. There's some nuance there.
I do believe it should be considered a hate crime because it speaks specifically to a group of people whereas burning an American flag is more associated with policy.
shouldn't be a crime at all, it is just a piece of cloth it is done to get under peoples skin look the other way got on with your life!

No. It’s just a flag. But i guess it could count as part of something else that would be. If you’re burning the pride flag while harassing gay people then the burning of the flag would I guess be part of the harassment and should add on

@AgapeLove first are Americans a disadvantaged group, are they oppressed for being American? Are there actual campaigns against them to reduce their rights and attacks against them for being American? Is the flag being burned that's someone's own flag or did someone come into their property, threaten them and then burn the flag?

These are pertinent questions. Hence the it can be, perhaps try for some nuance for once.
