It can be depending on context, intention, if it can harm people, etc.

@AgapeLove who said I'm for the state to take away anything? Nice strawman. It can be a hate crime if you purposely do it to harass LGBT people while threatening. Of course, you'll counter with the "woes" of "oppressed" cishet people, so I can predict where this is going.

@AgapeLove first are Americans a disadvantaged group, are they oppressed for being American? Are there actual campaigns against them to reduce their rights and attacks against them for being American? Is the flag being burned that's someone's own flag or did someone come into their property, threaten them and then burn the flag?

These are pertinent questions. Hence the it can be, perhaps try for some nuance for once.
