Just had baby, Husband fired from job today

So we just had a baby 5 and a half months ago. Husband has been at his job for over 10 years and is supposedly a top performer (by the numbers).They fired him not for missing necessarily but for not giving enough notice. They wanted 2 weeks notice everytime. But when you have a baby and they are sick.. I mean that isnt possible. He still had a week of PTO left even.. Everytime he missed it was for doctor's appointments for the baby and to stay home with her when she was sick. I work full time too, but do not make enough to cover our rent by myself and other bills. Im freaking out.. He is SO depressed and im worried sick. They are refusing severance.. I dont know if he will get unemployment..He says they never gave him any formal warning about how not giving enough notice could result in losing his job. Please ANYONE.. Have you been in this situation? please share how you go through this. Advice? help help help

Talk to an experienced labor attorney. This could fall under FMLA and his termination may not be within the guidelines of the statute. The size of the employer comes into play with respect to application of the law, where small businesses, and you have to abide by employer leave policies, and may have to assert FMLA status when requesting leave. It sounds like he was fired on a technicality and an appeal through an attorney may have merit to reinstate him. Talk to a couple of attorneys to see if there’s any legal redress of the issue.
