The world is insane, but that's not exactly what happened.
A judge did rule that under existing laws and how they're written, the courts are powerless to charge or convict someone for creating AI imagery as it causes no direct harm to an actual person. It ends up as a protected action under the 1st Amendment. Particularly article 19.
The judge wasn't pleased about ruling the way he did and did try to make that clear in his decision.

I agree with anyone that thinks that anything posing underage images be defined as ILLEGAL.
I am not here trying to defend anything that has been decided and ruled upon.
I am completely aghast, infuriated, and totally frustrated with the way our system of governance seems to work sonetimes.
Especially in the things like this.
But we do have a Constitution that attempts to bestow upon all of us the rights and considerations that are supposedly inherent to all of God's children.
And it does so inside of the constrictions of law and governance.
This is how anime porn became so prolific.
The 1st amendment is an undying inherent.
The 19th article..., maybe not so much.
But we must tread lightly despite how oddly these rights are perverted and used in ways that make us cringe.
Because in this world we live in, every right we fight against is another right we give up to those that rule and overlord over us.
And even as it is easy enough to pretend that we are not ruled by malicious overlords...
We most definitely are.

I think it's a State by State thing. It should be illegal Josh Powell had cartoon child pornography on his computer and that was illegal he also murdered his wife and two sons.
