It was a premeditated act. You can only shoot trespassers if you are certain your life is in danger. You have to issue a verbal warning before you shoot.

Premeditated means he was prepared to use his shotgun on an intruder after setting up a trap for a burglar. He was sat outside his garage with a loaded shotgun . It was not a spur of the moment decision. What do you think premeditated means?

He admits that he placed his wife's handbag in his garage and left the garage door wide open with the internal light on. He explained he had set a trap to catch a burglar. Why would I lie about that?
