Restore, strengthen, and tighten privacy laws so citizens have real protection from governments and corporations. Make the Fourth Amendment truly meaningful.

And here is my plan to do so.

In my first 30 days, I’d issue an executive order telling every federal agency to make “privacy‑first” their default for collecting and sharing data and I’d pause any bulk data collection that doesn’t have a warrant. I’d instruct the Justice Department to rewrite surveillance rules so that things like location tracking, real‑time cell‑site/IMSI surveillance, and accessing cloud content all require individualized probable‑cause warrants. Finally, I’d freeze any agency contracts that enable mass data collection from private companies until those deals pass a strict compliance review.

Within 90 days I’d push Congress to pass a strong Federal Privacy Protection Act. It would make clear that the government needs a judicial probable cause warrant to access anyone’s digital content, location information, or bulk datasets. No vague “national security” loopholes. Data collection would be limited to the minimum necessary for a defined purpose and would automatically be deleted after a set time. The law would require public reporting on government data requests (with only narrow, well justified national security exceptions) and would bar companies from selling or transferring personal data in bulk to the government without a warrant. Companies would have to notify users when the government requests their information unless a judge orders otherwise. Data holders would have a legal duty to protect users interests and build privacy into their products.

The bill would create real remedies. Its a private right of action, meaningful statutory damages, and civil and criminal penalties for unlawful surveillance and establish an independent Privacy Protection Office with subpoena power and authority to audit agency privacy practices.

Then I would appoint federal judges and nominate a Supreme Court advocate who have strong records on the Fourth Amendment, privacy, and digital rights. I’d also direct the Justice Department and the FTC to coordinate enforcement, DOJ would handle constitutional violations while the FTC would tackle corporate privacy abuses and set up a joint task force for rapid response.

Then I’d clamp down on surveillance‑based advertising: require businesses to obtain explicit opt‑ins before using sensitive data for targeted advertising, and present those opt‑ins in clear, plain, and easily understandable language. I’d impose hefty fines for nonconsensual tracking, offer tax credits and certification programs for companies that meet strong privacy standards, and penalize firms that monetize mass personal data without users’ permission.
