Firstly, he was in line of succession but at number 8, meaning he becoming king would be very unlikely anyway.
Secondly, he has not been accused in any legal sense of anything (i.e. not charged), but is under investigation over suspicions of possible "misconduct in public office" - a rather broad-brush, case-law rather than Statute charge.
