So far, there are no tariffs being levied on any country that exports to the USA.
KunsanVeteran · M
@swirlie As of right now, they go into effect on Wednesday.

The original Executive order goes into effect on Wednesday, but the tariffs themselves don't actually start for a long time up the road because there is no mechanism in place yet to collect or distribute any tariffs that are collected.
Until that mechanism is established, any tariffs that ARE collected are actually being pocketed by the retailer who sold you stuff.

@swirlie Ah, okay, I assumed they would commence with the order.

The Executive Order is signed by Trump, then it goes to Congress/Senate/etc where it becomes approved or disapproved. The POTUS himself cannot unilaterally decide to impose tariffs on any country. That function comes from government, not the President. If Trump could unilaterally impose tariffs, then you would have a constitutional failure on your hands and the USA would be deemed a Dictatorship, not a Democratic Republic.
See, that's the thing... Americans and the rest of the world are behaving like Trump is a fascist Dictator when in fact he is still just a President operating within a Democratic Republic. The bottom line is, if the Senate disagrees with Trump through a vote, then tariffs are dead in the water for Trump and nothing happens.
Trump talks like he's calling the shots which is why he's not getting ANY pushback from government. The Senate and Congress don't actually have to say anything to him because they already know that Trump can't do anything on his own without their approval first!
If tariffs look like a good thing to those in government, including the Dems, then tariffs will fly. But if the Senate takes back their full control of the concept of tariffs and they tell Trump to go fukk himself, then Trump will have no choice but to back down on the tariff threats.

@swirlie But he has attempted to enact the war powers act of 1798 which I believe does let him impose tariffs and a lot of other powers.
swirlie · F
@KunsanVeteran
But the war powers act only applies if the USA were under a direct threat of war, which is why Trump got laughed at for suggesting the use of that act.

@swirlie It’s still being litigated over the deportations. It’s not settled yet. And the SCOTUS has put a stay on the judges’ order (appeals court).
You are probably correct, but so many legal decisions are in flux right now with all this chaos.

My understanding is that tRUMP’s admittedly extremely weak justification to use the War Powers Act was that the US and Venezuela were at “economic war” because criminal gangs in the US are here from Venezuela.

@KunsanVeteran
That is my understanding as well. Great minds think alike.
