Attorneys Brian Kabateck and Shant Karnikian cover Trump's emergency appeal to the Supreme Court asking it to reinstate his March executive order that would turn the Postal Service into a citizenship gatekeeper for mail-in ballots.
The order directs DHS and SSA to create a federal list of eligible voters, then bars USPS from delivering ballots to anyone not on it. Twenty-three states and D.C. sued. Judge Talwani blocked it. The First Circuit upheld the block.
Now with fewer than 100 days until the midterms, the DOJ is asking the same Supreme Court that ruled 5-4 in Watson v. RNC to reverse course. Brian and Shant point out the problem: the court already ruled this term that states control elections, not the president. Barrett wrote the majority opinion. Roberts joined.
The legal theory is the same one that already lost. The practical problem is just as fatal: building a reliable citizenship database, coordinating it with USPS, and screening millions of voters in under 100 days is logistically impossible, and the SAVE database has already been shown to misidentify citizens. Shant predicts the petition gets denied, possibly in as few as four words: "The petition is denied."
The voter fraud pretext is just that, a pretext to disenfranchise voters in an election cycle where Republicans are historically vulnerable.
