Judge Orders Release of Suspect Wanted Abroad After Key Details Withheld in Court

A federal judge ordered the release of a man wanted for homicide in the Dominican Republic after learning that critical information about his background was not disclosed during court proceedings.

Bryan Rafael Gomez, 27, was released from ICE custody in Rhode Island on $500 bail following a ruling by Melissa DuBose, who said the government failed to justify his continued detention under the law.

DuBose determined that Gomez had been held under legal authority intended for migrants apprehended at the border, even though he had been arrested within the United States. Based on the filings presented, she ruled that his detention did not meet the required standard and ordered his release pending a bond hearing before an immigration judge.

The case shifted after additional information emerged.

Gomez is the subject of an arrest warrant issued by authorities in the Dominican Republic in January 2023 for homicide. That information was not included in the court filings used in the judge’s initial decision and was only referenced briefly in an agency press release.

Assistant U.S. Attorney Kevin Bolan said in court filings that he had been instructed not to include the information about Gomez’s status as a wanted individual.

@Midlifemale So most likely, ICE lied and cheated when they apprehended this person. Seems that law enforcement needs to obey the law. Who knew??

@sunsporter1649 ICE has established a major pattern of lawbreaking, and it's like nothing we've ever seen before. Each of the 96 court orders mentioned below is the result of one or more laws broken by ICE. Ignoring the court order is an additional crime. And these 96 are just the ones that moved thru the courts quickly, the so-called tip of the ICEberg!

... on Wednesday, Patrick Schiltz, the chief judge for the U.S. District Court of Minnesota, issued a remarkable order that cataloged a total of 96 court orders that he said ICE had violated in 74 different cases. “ICE has likely violated more court orders in January 2026,” the judge wrote, “than some federal agencies have violated in their entire existence.”

ICE is simply the most egregious official breaker of laws. They must be held accountable, just like every other criminal. It sends absolutely the wrong message to let them all go without even investigating.

I assume the tRump DoJ is doing their best to prosecute them. There haven't been many charges filed though. Is it because tRump's DoJ is incompetent?? Or maybe you're just wrong about your whole "facilitate" claim. BTW, You'll find that protesting crimes by ICE isn't itself a crime.

AND. Most of the people you call "illegal" were admitted under Temporary Protected Status, and then tRump eliminated their TPS with a stroke of his sharpie. Their only crime was incurring tRump's capricious wrath.
