Federal Judge Overturns Biden’s Permanent Ban On Offshore Drilling Across 625 Million Acres

Judge James Cain, appointed during Trump’s first term, ruled that Biden’s attempt to permanently block offshore drilling across 625 million acres of American waters was illegal. Not just misguided. Not just bad policy. Illegal. The judge didn’t mince words about what Biden tried to pull off in his final days, desperately trying to cement his radical agenda before Trump’s return.

To the extent these were indeed supposed to overcome the power of subsequent executives to revoke or modify their withdrawals, they constituted a departure from the executive branch’s longstanding practice and exceed the authority granted under (section 12(a) of OCSLA).

These weren’t policy disagreements – they were constitutional violations. Think about the sheer scope of what Biden attempted. The entire East Coast. The entire West Coast. Massive sections of Alaska. The Eastern Gulf of Mexico. All of it meant to be locked away forever, denying Americans access to their own resources while we beg other nations for energy. This wasn’t governance – it was sabotage.

What makes this ruling particularly sweet is that Judge Cain didn’t just slap down Biden. He reached back and cited Obama for the same constitutional violations. Two Democrat presidents, both convinced they could rule by decree, both caught red-handed exceeding their legal authority. It’s a pattern we’ve seen before: when Democrats can’t win through legislation, they try to rule through executive fiat.
