Judge Holds ICE Agent In Contempt For Detaining Illegal Migrant During Trial
ICE agent Brian Sullivan apprehended Wilson Martell-Lebron last week as he was leaving the courthouse. However, a Boston Municipal Court judge ruled on Monday that Sullivan had violated Martell-Lebron’s rights to due process and a fair trial by taking him into custody during the proceedings, the Associated Press reported.
“It’s a case of violating a defendant’s right to present at trial and confront witnesses against him,” Judge Mark Summerville said from the bench. “It couldn’t be more serious.” Advertisement
Summerville dismissed the charge against Martell-Lebron for making false statements on his driver’s license application—specifically, claiming he wasn’t Martell-Lebron, the report said. Following this action, the judge filed the contempt charge against Sullivan, which may prompt Suffolk County District Attorney Kevin Hayden to review the case and decide whether any charges should be pursued.

Constitutionally, a "time of public danger" as referenced in the Fifth Amendment's Grand Jury Clause, encompasses situations beyond just war or foreign invasion, including threats like plagues, financial panics, jailbreaks, and natural disasters, where the militia or military may be called upon to restore order.
None of those conditions were or are happening. Gestapo tactics (and gazpacho tactics) need to be nipped in the bud.

It's shocking how easily @Reason10 and her ilk are willing to suspend due process protections. She's willing to let any beat cop on the street decide "public danger," execute an extraordinary rendition, and cart her body off to a foreign gulag!!
Yeah, I know, she thinks the due process suspension would only apply to brown people and people with accents, not to white citizens like herself. But the 5th amendment makes no citizenship distinctions. If a low level functionary can suspend due process for a person who appears foreign, they can suspend it for someone who appears domestic just as easily!
P.S. Yes, I know, @Reason10 prefers he/his pronouns, but didn't we recently pass laws that say we don't have to use a person's preferred pronouns??
