A new report claims that many documents signed by former President Joe Biden during his administration were executed using an autopen, raising questions about who was making decisions during his presidency.
The Oversight Project examined numerous documents bearing Biden’s signature throughout his four-year term, according to the report shared on X. They claim all signatures analyzed showed consistent autopen characteristics, with the exception of the document announcing his withdrawal from the 2024 presidential race last July.
To support their claims, the group shared examples from documents dated August 2022 and December 2024, suggesting the signatures appeared identical. They contrasted these with Biden’s signature on his campaign exit announcement, which showed slight variations.
The Daily Mail conducted its own examination, reviewing over 25 Biden executive orders on the Federal Register’s website spanning from 2021 to 2025. Their analysis found consistent signatures across all documents.
A similar review of 25 Trump-signed orders from both his administrations revealed the same consistency pattern, per the outlet.
Daily Mail went on to explain that autopens, mechanical devices that reproduce signatures without requiring the individual’s physical presence, have been utilized by presidents and lawmakers for decades as a standard administrative tool.
The Oversight Project raised questions about who controlled the autopen mechanism and what verification processes existed.
“For investigators to determine whether then-President Biden actually ordered the signature of relevant legal documents, or if he even had the mental capacity to, they must first determine who controlled the autopen and what checks there were in place,” the group stated.
Their investigation gained momentum after Attorney General Andrew Bailey (R-MO) called for a Justice Department investigation into whether Biden’s “cognitive decline allowed unelected staff to push through radical policy without his knowing approval.”
Bailey, a Trump ally, submitted a letter to the Justice Department inspector general on March 4 requesting an official probe into Biden’s final days in office. He argued that if Biden was being exploited, the resulting orders could be “null and void,” and states need clarity on the matter.
The controversy extends beyond the Heritage Foundation’s report. Daily Mail highlighted that according to Bailey’s letter, House Speaker Mike Johnson claimed Biden appeared unaware of what orders he had been signing during their conversations.
